FIRST AMENDMENT TO <br /> DEVELOPMENT AGREEMENT /, <br /> This First Amendment to Development Agreement("Amendment")is entered into this,j day <br /> of ✓,2018, by the parties set forth below,and amends the Development Agreement <br /> dated anuary 10, 2011 by and between Earth Holdings, LLC, Thomas Subitch, Lanswell <br /> Development, Marlene and Harlin Lindstrand("Owners"), and the City of Everett("City"), a <br /> true and correct copy of which is attached to this Amendment. <br /> RECITALS <br /> A. On February 5, 2018, Sonrise Christian Center, a nonprofit corporation,purchased <br /> approximately 1.33 acres of real property that was formerly owned by Lanswell <br /> Development Corporation and was identified in, and made subject to, the Development <br /> Agreement("Sonrise Parcel"). The Sonrise Parcel is legally described on Exhibit A <br /> attached to the Development Agreement as property#4, and marked as the"Lanswell C-1 <br /> Parcel on Exhibit B attached to the Development Agreement. <br /> B. Sonrise Christian Center desires to develop the Sonrise Parcel as an additional parking lot <br /> to serve its adjacent property,which development is inconsistent with the rezone <br /> effectuated by the Development Agreement. <br /> C. The"Owners"under the Development Agreement do not object to removal of the Sonrise <br /> Parcel and enter into this Amendment to allow Sonrise Christian Center to proceed with <br /> its development plans without the restrictions in the Development Agreement. <br /> AGREEMENT <br /> The parties agree as follows: <br /> 1. Amend Section 1.1 of the development agreement to read as follows: <br /> "The property shall be developed as an integrated development incorporating all parcels of land <br /> in a business park, industrial park or commercial center developed as a single site development <br /> plan.The development may be phased through the binding site plan subdivision process. <br /> Individual parcels shall not be permitted to be developed until a binding site plan subdivision has <br /> been approved by the City that approves the location of buildings,parking,access,landscaping <br /> and all undevelopable areas." <br /> 2. Amend Section 1.8 of the development agreement to read as follows: <br /> First Amendment to Development Agreement 2 <br />
