EVERETT <br /> WASHINGTON <br /> ORDINANCE NO. 3688-19 <br /> An Ordinance Relating to Surface and Storm Drainage, amending Ordinance No. 3528-16 (Chapter 14.28 <br /> EMC), as previously amended <br /> WHEREAS, <br /> A. As set forth in Chapter 14.28 of the Everett Municipal Code,the City uses the current Department <br /> of Ecology Stormwater Management Manual for Western Washington. <br /> B. This Stormwater Manual is revised by the Department of Ecology from time-to-time. The purpose <br /> of this ordinance to clarify that a revised manual takes effect 90 days after issuance and that the <br /> City Engineer may establish a different effective date. <br /> NOW,THEREFORE,THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1. Paragraph 37 of Section 2 of Ordinance 3528-16, as amended (codified at EMC <br /> 14.28.020 (37)), is amended as follows, with underlining added: <br /> (37) "Stormwater Management Manual" shall mean the most current Washington State <br /> Department of Ecology Stormwater Management Manual for Western Washington, along with <br /> any technical and administrative procedures established by the City Engineer which provide <br /> details for implementation of the provisions of this chapter. When the Washington State <br /> Department of Ecology issues a new or revised Stormwater Management Manual for Western <br /> Washington, the new or revised manual will for the purposes of this chapter take effect 90 days <br /> after such issuance, unless the city engineer establishes a different effective date. <br /> Section 2. The City Clerk and the codifiers of this Ordinance are authorized to make necessary <br /> corrections to this Ordinance including, but not limited to,the correction of scrivener's/clerical errors, <br /> references, ordinance numbering, section/subsection numbers, and any internal references. <br /> Section 3. The City Council hereby declares that should any section, paragraph, sentence, clause or <br /> phrase of this ordinance be declared invalid for any reason, it is the intent of the City Council that it <br /> would have passed all portions of this ordinance independent of the elimination of any such portion as <br /> may be declared invalid. <br /> Section 4. The enactment of this Ordinance shall not affect any case, proceeding, appeal or other <br />
