Section 11. INSURANCE. AWA shall maintain commercial general liability insurance coverage during the term of this License with$1,000,000 combined single limits, which insurance shall be primary and non-contributing. AWA shall ensure the City is endorsed as an additional insured on the policy. AWA shall provide the City evidence of coverage and endorsement. Insurance coverage and limits of liability as specified herein are minimum coverage and limit of liability requirements only. They shall not be construed to limit the liability of AWA or any insurer for any claim that is required to be covered hereunder. Moreover, the City shall be an additional insured, where additional insured status is required, for the full available limits of liability maintained by AWA, whether those limits are primary, excess, contingent or otherwise. Section 12. NON-INTERFERENCE WITH CITY USE. AWA use of the Property shall not interfere in any way with any City use of the Property, including utilities and travel. Section 13. SERVICES. AWA shall provide at its own expense any services that it may require including but not limited to electricity needs, water, sewer, and garbage services. Section 14. REPAIR OF PROPERTY. AWA shall use care to avoid damaging or destroying City property by reason of its operations pursuant to this License. Any damage caused by AWA to City or other property shall be promptly repaired or replaced by AWA to the satisfaction of the City, or in lieu of such repair or replacement, AWA shall pay, to the City or owner of the other property, money in an amount sufficient to compensate for the loss sustained by reason of damage to or destruction of the City's or other party's property. Section 15. RISK OF LOSS TO GRANTEE'S PROPERTY. AWA bears all risk of any and all damage and loss to its equipment or materials being stored on the Property. Section 16. Intentionally Omitted. Section 17. NO WARRANTY. The City does not warrant its title or ownership of the Property. Section 18. NON-EXCLUSIVE. This License is not exclusive. The City is not prohibited from granting permission to others to occupy or use portions of the Property where such uses are not inconsistent with this License. Section 19. RESERVATION OF RIGHTS. The City reserves all rights not expressly granted by this License. Section 20. NO THIRD PARTY RIGHTS. This License does not create any rights in any third party. page 3
