• <br /> = = <br /> ORDINANCE NO. :? <br /> 11 <br /> 21 AN ORDINANCE PROVIDING FOR THE VACATION OF: <br /> 3�j The alley lying between the north property lines of <br /> Oil Lots 11, 12, 13 and 14 plus the westerly 12 .5 feet of <br /> jj the north property line of Lot 15 and the south property <br /> 511 line of Lot 10, alley in Block 713, Plat of Everett <br /> j Land Company's First Addition. <br /> 6'i <br /> H WHEREAS, the owners of more than two-thirds of the private <br /> 7property abutting upon the streets and alleys above described have <br /> 8 ! duly filed a petition with the City Council of the City of Everett <br /> praying .praying for vacation of said streets and alleys; and, <br /> 9 <br /> WHEREAS, said City Council of the City of Everett did by <br /> 10 ; resolution duly adopted, fix the 5th day of September, 1968, at <br /> 119:00 a.m. of said day for the hearing and determination of said <br /> petition; and, <br /> 121 WHEREAS, due and legal notice of the time and place of said <br /> 13 hearing and the determination of said petition has been given by the <br /> City Clerk in the manner prescribed by law; and, <br /> 14i• <br /> WHEREAS, at the time and place fixed for hearing, objections <br /> 151to the vacating of the herein described streets and alleys were <br /> Sheard and discussed; and, <br /> 16 ' <br /> WHEREAS, it now appears to the City Council of the City of <br /> 17 'Everett that a portion of said streets and alleys petitioned to be <br /> ,vacated should be vacated; <br /> 18 <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 19 <br /> Section 1: That the streets and alleys of the City of <br /> 20 Everett, County of Snohomish, State of Washington, described as <br /> 21 follows, to wit: <br /> 22ii The alley lying between the north property lines of <br /> Lots 11, 12, 13 and 14 plus the westerly 12 .5 feet of <br /> 23 the north property line of Lot 15 and the south property <br /> line of Lot 10, alley in Block 713, Plat of Everett <br /> 24 ' Land Company First Addition, <br /> 251be, and the same is hereby vacated, SUBJECT to the following condi- <br /> 'tions, restrictions and reservations: <br /> 26 <br /> The City of Everett retains an easement to construct, <br /> 271 operate, maintain, repair and replace all public utili- <br /> ties under, over and across said property.
