10. The Planning Commission held a public hearing on April 16, 2019, and adopted a <br /> resolution recommending that the City Council approve the proposed amendment to the <br /> PDO master plan. <br /> WHEREAS, the City Council concludes the following: <br /> 1. The proposed major amendment to the Waterfront Place PDO master plan: <br /> a. is consistent with the Everett Comprehensive Plan; <br /> b. does not create any impacts to surrounding properties that require mitigation; and <br /> c. is in the best long-term interests of the Everett community. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br /> EVERETT: <br /> Section 1. Section 2 of Resolution No. 5382 as amended by Resolution Nos. 5703 and 6814 is <br /> amended to substitute Exhibits 1 and 3 in Exhibit A of the Amended and Restated Development <br /> Agreement with the revised attached Exhibits 1 and 3 to Exhibit A. <br /> Section 2. This Resolution authorizes the Mayor to sign the this First Amendment to the <br /> Amended and Restated Development Agreement between the City of Everett and Port of <br /> Everett for the Waterfront Place Planned Development Place Planned Development <br /> Overlay Zone Master Plan. This Resolution along with the First Amendment including <br /> exhibits shall be recorded with the Snohomish County Auditor's Office and shall be a <br /> covenant running with the land. <br /> Section 3. The City Clerk and the codifiers of this Resolution are authorized to make necessary <br /> corrections to the Resolution and exhibits, including but not limited to, correction of scrivener's/ <br /> clerical errors, references, resolution numbering, section and subsection numbers, and any <br /> references thereto. <br /> Councilmember Introd g Re elution <br /> Passed and approved this 5 day of June , 2019. <br /> 10 <br /> City f •uncil Pres'•-nt <br />
