CITY <br /> FIRST AMENDMENT TO THE AMENDED AND RESTATED DEVELOPMENT <br /> AGREEMENT BETWEEN THE CITY OF EVERETT AND PORT OF EVERETT FOR THE <br /> WATERFRONT PLACE PLANNED DEVELOPMENT OVERLAY ZONE MASTER PLAN <br /> This First Amendment to the Amended and Restated Development Agreement between the City <br /> of Everett and Port of Everett for the Waterfront Place Planned Development Overlay Zone <br /> Master Plan is entered into this26 day ofh p ,.2019, by and between the Port of Everett, a <br /> Washington Port District(hereinafter, "the dort")and the City of Everett,a municipal corporation <br /> under the laws of the State of Washington (hereinafter, "the City"). <br /> WHEREAS,the City and Port executed an Amended and Restated Development Agreement on January <br /> 21, 2015, concerning a redevelopment plan on property owned by the Port, known as Waterfront Place, <br /> for a mixed use master land use plan; and <br /> WHEREAS,the Port applied to the City for an amendment to the master plan involving the realignment <br /> of Weaver Street within the master plan; and <br /> WHEREAS,the City Council has approved the amendment changing the alignment of Weaver Street as <br /> depicted on Exhibit 1, attached to this Amendment; and <br /> WHEREAS,the amendment depicted on the attached Exhibits necessitates the amendment of Exhibit 1 <br /> (Conceptual Site Plan) of Exhibit A and Exhibit 3 (Right-of-Way Improvements) of Exhibit A of the <br /> Amended and Restated Development Agreement, and <br /> NOW THEREFORE,the parties herein do hereby mutually agree as follows: <br /> 1. Exhibit 1 and Exhibit 3 of Exhibit A of the Amended and Restated Development Agreement shall <br /> be replaced with new exhibits that change only the alignment of Weaver Street as depicted in <br /> the attached exhibits of this First Amendment. <br /> 2. The revised Exhibits 1 and 3 of Exhibit A shall govern design and construction of improvements <br /> and the application of development standards for future development within the Waterfront <br /> Place Planned Development Overlay zone master plan. <br /> 3.
