• <br /> • <br /> • <br /> • <br /> • <br /> ORDINANCE NO. 4/2/[/ <br /> AN ORDINANCE GRANTING TO THE GREAT NORTHERN RAILWAY <br /> COMPANY, ITS SUCCESSORS OR ASSIGNS, THE RIGHT, PRIVILEGE AND <br /> AUTHORITY TO LOCATE, LAY DOWN, CONSTRUCT, MAINTAIN AND <br /> OPERATE, FOR A PERIOD OF TWENTY-FIVE YEARS FROM AND AFTER <br /> THIS ORDINANCE BECOMES EFFECTIVE, A RAILROAD SPUR TRACK <br /> OVER AND ACROSS PACIFIC AVENUE AT A POINT APPROXIMATELY <br /> 110 FEET EAST OF WALNUT STREET AND OVER AND ACROSS THAT <br /> CERTAIN STREET RIGHT-OF-WAY DESCRIBED.AS PACIFIC AVENUE <br /> EXTENSION, WALNUT TO HEWITT AVENUE IN THE STREET BOND <br /> ISSUE, ORDINANCE NO. 4192, WHICH IS TO BE ACQUIRED IN CONNECT- <br /> ION WITH THE STREET CONSTRUCTION AUTHORIZED BY SAID ORDIN- <br /> ANCE AT A POINT APPROXIMATELY 110 FEET EAST OF WALNUT <br /> STREET WITHIN THE CITY OF EVERETT TO A CONNECTION WITH THE <br /> TRACK OF THE GREAT NORTHERN RAILWAY COMPANY. <br /> THE CITY COUNCIL OF THE CITY OF EVERETT DOES HERE B Y � <br /> ORDAIN AS FOLLOWS: <br /> Section 1. <br /> That there is hereby granted to the Great Northern Railway <br /> Company, its successors or assigns, for a period of twenty-five years <br /> from and after the date this ordinance becomes effective, a right-of-way <br /> for the right, privilege and authority to lay down, construct and maintain <br /> a railroad spur track over and across Pacific Avenue at a point approx- <br /> imately 110 feet east of Walnut Street and over and across that certain <br /> street right-of-way described as Pacific Avenue Extension, Walnut to <br /> Hewitt Avenue in the Street Bond Issue, Ordinance No. 4192, which is to <br /> be acquired in connection with the street construction authorized by said <br /> ordinance at a point approximately 110 feet east of Walnut Street in the <br /> City of Everett to a connection with the track of the Great Northern Railway <br /> Company. <br /> Section 2. <br /> That wherever said track crosses the street or avenue now <br /> constructed or hereafter to be constructed, laid out or extended, said <br /> grantee, its successors and assigns, shall pave, plank and keep in repair <br /> all that portion of the improved street or avenue occupied by its tracks to <br /> a point three feet beyond the end of the ties at each side of said track. Said <br /> spur track shall be constructed at an elevation approved by the City of <br /> Everett. <br /> Section 3. <br /> Should the City desire to improve said street or avenue by the <br /> installation of pavement, water mains, sewer lines or other public utilities <br /> the grantee agrees to make such adjustments as are necessary to accom- <br /> modate such public improvements. <br /> Section 4. <br /> Said grantee, its successors and assigns will not allow its <br /> locomotives or cars to block or impair the free flow of traffic longer than <br /> reasonably necessary to make switches or to make-up and divide trains <br /> and cars, and in no event to impair the flow of traffic so as to create a line <br /> of east bound vehicles for a distance greater than between the spur track <br /> and Walnut Street. The grantee agrees that it shall immediately remove <br /> all locomotives and cars standing upon said track in said street or avenue <br /> to permit the passage of emergency vehicles on emergency calls and at such <br />
