• <br /> • <br /> ORDINANCE NO. 4/g/(,) <br /> AN ORDINANCE relating to the sale and delivery of firearms <br /> and prescribing penalties thereof. <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: It is unlawful for any merchant or secondhand dealer, <br /> or any clerk, agent or employee of any merchant or secondhand dealer, <br /> to sell, give away or dispose of any pistol to any person at retail, <br /> unless (1) such person is personally known to the seller or shall <br /> present clear evidence of his identity, and (2) unless such merchant <br /> or secondhand dealer shall complete a true record in triplicate of <br /> every pistol sold or disposed of and submit said record to the Chief <br /> of Police of the Cityof Everett. A complete record shall be <br /> personally signed by the purchaser and by the person effecting the <br /> sale, each in the presence of the other, and shall contain the date of <br /> sale, the caliber, make, model and manufacturer' s number of the <br /> weapon, the name, address, occupation, and place of birth of the <br /> purchaser, and a statement signed by the purchaser that he is not a <br /> fugitive from justice and that he has never been convicted in this <br /> state or elsewhere of a crime of violence or of drug addiction or of <br /> habitual drunkenness and has never been confined to a mental institu- <br /> tion. One copy shall be sent by registered mail to the Chief of <br /> Police of the City of Everett on the same date as such record is <br /> completed . The Chief of Police of the City of Everett, shall within <br /> seventy-two hours, exclusive of Saturdays, Sundays and holidays, <br /> investigate the information contained in said record. In the event <br /> records are incomplete, the Chief of Police may require that said <br /> record be resubmitted . The time for investigatinn shall only attach <br /> to submission of complete records as herein defined . <br /> Section 2: It is unlawful for any merchant or secondhand dealer or any <br /> clerk, agent or employee of any merchant or secondhand dealer to deliver <br /> any pistol to any purchaser within 72 hours exclusive of Saturdays, Sundays <br /> or holidays after such dealer has mailed a copy of the complete record <br /> in accordance with Section 1 of this ordinance. Also it is unlawful for <br /> any merchant or secondhand dealer or any clerk, agent or employee of <br /> any merchant or secondhand dealer to deliver any pistol to any person <br /> known by such merchant or secondhand dealer or any clerk, agent or <br /> employee of any merchant or secondhand dealer, to be a person who is a <br /> fugitive from justice or who has been convicted in this state or elsewhere <br /> of a crime of violence or of drug addiction or of habitual drunkenness <br /> or has been confined to a mental institution. Any merchant or secondhand <br /> dealer, or any clerk, agent or employee of any merchant or secondhand <br /> dealer, who shall have no knowledge that the purchaser is a fugitive from <br /> justice or a person convicted of a crime of violence or of drug addiction <br /> or of habitual drunkenness or has been confined to a mental institution, <br /> or shall receive no communication from the Chief of Police within 72 <br /> hours, exclusive of Saturdays , Sundays and holidays, after said merchant <br />
