apartment, shop or any other place within the city for the sole purpose of exhibiting <br /> samples and taking orders for future delivery; provided that anyone soliciting orders or <br /> transacting business with business establishments or retail or wholesale outlets for resale or <br /> retail sales by said outlets in the city shall be excluded from the definition herein set forth <br /> and the scope of this chapter. <br /> C. A"food truck" is a business that, as its principal function, sells or otherwise dispenses <br /> prepared food and beverages to the general public from a licensed motor vehicle that is not <br /> permanently affixed to real property. The term excludes food delivery vehicles that move <br /> from place to place and are stationary for no more than 30 minutes at a time, such as ice <br /> cream trucks. <br /> Section 3. Section 8 of chapter 9 of Ordinance 295-74 (codified at EMC 5.36.080), is amended as <br /> follows, with strikeouts deleted and underlining added: <br /> Except as authorized by chapter 20.08 EMC, noise control,N no peddler, nor any person in his behalf, <br /> shall shout, make any cryout, blow a horn, ring a bell or use any sound device, including any <br /> loudspeaking radio or sound amplifying system upon any of the streets, alleys, parks or other public <br /> places of said city or upon any private premises in the said city where sound of sufficient volume is <br /> emitted or produced therefrom to be capable of being plainly heard upon the streets, avenues, alleys, <br /> parks or other public places, for the purpose of attracting attention to any goods, wares or merchandise <br /> which such licensee proposes to sell. <br /> Section 4. The City Clerk and the codifiers of this Ordinance are authorized to make necessary <br /> corrections to this Ordinance including, but not limited to, the correction of scrivener's/clerical errors, <br /> references, ordinance numbering, section/subsection numbers, and any internal references. <br /> Section 5. The City Council hereby declares that should any section, paragraph, sentence, clause or <br /> phrase of this ordinance be declared invalid for any reason, it is the intent of the City Council that it <br /> would have passed all portions of this ordinance independent of the elimination of any such portion as <br /> may be declared invalid. <br /> Section 6. The enactment of this Ordinance shall not affect any case, proceeding, appeal or other <br /> matter currently pending in any court or in any way modify any right or liability, civil or criminal, which <br /> may be in existence on the effective date of this Ordinance. <br /> In 2019 ORDINANCE: Mobile Food Units Page 3 of 4 <br />
