Second Reading <br /> Third Reading <br /> Public Hearing <br /> Budget Advisory Initialed by: <br /> Department Head <br /> Administration <br /> Council President <br /> Location Preceding Action Attachments Department(s)Approval <br /> Proposed Ordinance Legal <br /> Amount Budgeted -0- <br /> Expenditure Required -0- Account Number(s): <br /> Budget Remaining -0- <br /> Additional Required -0- <br /> DETAILED SU1VLMARY STATEMENT: <br /> The prosecutor's office is proposing the adoption of RCW 9A.52.020-.030 as a local ordinance entitled <br /> "Interference with a Health Care Facility."This statute makes it a gross misdemeanor for a health care <br /> facility to be disrupted by physical obstruction or impeding a person entering or leaving the facility; making <br /> noise that unreasonably disturbs the peace within the facility; trespassing;repeatedly telephoning the facility; <br /> or threatening to inflict injury or knowingly permitting someone to use your telephone to threaten. <br /> Although this RCW was written in 1993 for the purpose of protecting women's health care facilities, it <br /> protects all health care facilities.A number of cases have been reviewed by Lead Prosecutor Leslie Tidball <br /> that included situations in the local hospital emergency room—which caused tremendous stress on the <br /> hospital staff by the person's behavior—that were not prosecutable under other laws, but could have been <br /> prosecutable under this proposed ordinance.This ordinance could also assist in situations where gang <br /> members show up at the emergency room and engage in disruptive behavior after one of their members is <br /> being treated at the health care facility. <br /> RECOMMENDATION(Exact action requested of Council): <br /> Adopt an Ordinance Relating to Interference with a Health Care Facility, amending Ordinance No. 1145-85, <br /> as previously amended. <br /> 89 <br />
