. ti <br /> ORDINANCE NO. u' 2 J_ <br /> AN ORDINANCE amending Ordinance No. 4255 of the City <br /> of Everett by adding a new section thereto, thereby known as Section <br /> 4, being an ordinance providing for the annexation of certain proper- <br /> ties to the City of Everett and providing for the assumption of exist- <br /> ing indebtedness of the City by the annexed territory and declaring an <br /> emergency to exist. <br /> WHEREAS, pursuant to R.C.W. 35.13.130 a petition was <br /> presented to the City Council of the City of Everett proposing the <br /> annexation of certain property, and <br /> WHEREAS, the City Council of the City of Everett, on <br /> the 16th day of October, 1967, did adopt a resolution accepting the <br /> petition for annexation of the property hereinafter described, provid- <br /> ing that said property annexed shall assume all existing indebtedness <br /> of the City of Everett, including the general bond issue adopted by <br /> the electorate of the City of Everett on the 7th day of February, 1967, <br /> and <br /> WHEREAS, The City of Everett did approve the filing of a <br /> petition for annexation and thereafter a petition pursuant to R.C.W. <br /> 35.13.130 signed by owners of not less than seventy-five per cent in <br /> value according to the assessed valuation for general taxes of the <br /> property proposed to be annexed was filed with the City of Everett, and <br /> WHEREAS, the Review Board provided by R.C.W. 35.13.171 <br /> has approved said annexation, and <br /> WHEREAS, the Commissioners of the City of Everett, a <br /> municipal corporation, did fix the 14th day of November, 1967, for hear- <br /> ing upon said petition, and caused notice of hearing to be published <br /> in one issue of the Everett Daily Herald, a newspaper of general circu- <br /> lation in the City, and caused said notice also to be posted in three <br /> (3) places within the territory proposed for annexation, which notice <br /> as published and as posted specified the time and place of hearing and <br /> invited interested persons to appear and voice approval or disapproval <br /> of the annexation, and <br /> WHEREAS, following the hearing, the Commissioners of Everett, <br /> a municipal corporation, have determined to annex all of the property des- <br /> cribed in the petition as hereinafter set forth, and <br /> WHEREAS, Ordinance No. 4255 was adopted, providing for the <br /> annexation of the property hereinafter described, but failed to make any <br /> statement that said property annexed would be subject to and liable for <br /> its proportionate share of all existing indebtedness of the City of <br /> Everett contracted prior to or in existence at the time of the annexation, <br /> all as required by resolution adopted by the City of Everett and incorpor- <br /> ated in the petition of the owners presented to the City of Everett: <br /> The Northwest 1/4 of the Northeast 1/4 lying Westerly <br /> of Primary State Highway No. 1 (also known as Interstate <br /> -1- <br />
