<br /> 7 i - WHEREAS, the owners of more than two-thirds of the pri-
<br /> vate property abutting upon the street and alley above described
<br /> 8 lhave duly filed their petitions with the City Council of Everett
<br /> Lpraying for the vacation of said street and alley, and,
<br /> WHEREAS, said City Council of the City of Everett did by
<br /> 10 ! resolution duly adopted, fix the 10th day of February, 1967, at
<br /> I0:00 A.M. of said day for the hearing and determination of said
<br /> 11 illetitioni and.,
<br /> 12
<br /> WHEREAS, due and legal notice of the time and place of
<br /> said hearing and the determination of said petition has been given
<br /> 13 by the City Clerk in the manner prescribed by law, and,
<br /> 14 I' WHEREAS, at the time and place fixed for hearing objec-
<br /> tions to the vacating of the herein described street and alley were
<br /> 15 !heard and discussed, and
<br /> 16 1,1 WHEREAS, it now appears to the City Council that said
<br /> ipetition should be granted subject to certain reservations and
<br /> 17 exceptions and said City Council does hereby determine to vacate
<br /> the above described street and alley subject to certain reserva-
<br /> 18 tions and exceptions,
<br /> 19 III NOW, THEREFORE, THE CITY' OF EVERETT DOES ORDAIN:
<br /> 20 , Section 1: That the street and alley in the City of
<br /> Everett, County or Snohomish, State of Washington, described as
<br /> 21 1 follows, to-wit:
<br /> 22 The central alley, running north and south from one
<br /> of the east-west alleys to the other east-west alley,
<br /> 23 1 in Block NO. 659, Division 14 Plat of Everett,
<br /> 24 be, and the same is hereby vacated subject to the following con-
<br /> ditions, restrictions and reservations: The City of Everett re-
<br /> 25 tains an easement to construct, operate, maintain, repair, replace
<br /> • liand add thereto, all public utilities, and to grant the construe-
<br /> .1.- 26 iltion operation and maintenance of other public utilities, includ-
<br /> ing but not limited to telephone, gas, electricity, and conditioned
<br /> 27 further that no structures of any permanent nature shall ever be
<br /> constructed over said street and, alley vacated.
