<br /> J \ AN ORDINANCE providing for the vacation of the following described
<br /> `4 street and alley in the City of Everett, County of Snohomish, State of
<br /> -at '(;
<br /> Washington, to-wit:
<br /> 1 Rainier Drive from the south line of Lot 22, Block 6, Beverly Hills
<br /> Division No. 2, north to the south line of Lake Street,
<br /> tdo declaring an emergency to exist.

<br /> C" WHEREAS, the owners of more than two-thirds of the private property
<br /> `) abutting upon the street and alley above described have duly filed their
<br /> epi petitions with the City Council of Everett praying for the vacation of said
<br /> street and alley, and
<br /> WHEREAS, said City Council of the City of Everett did by resolution
<br /> duly adopted, fix the 24th day of May, 1966, at 10:00 A.H., of said day for the
<br /> hearing and determination of said petition, and
<br /> WHEREAS, due and legal notice of the time and place of said hearing and
<br /> the determination of said petition has been given by the City Clerk in the manner
<br /> prescribed by law, and
<br /> WHEREAS, at the time and place fixed for hearing objections to the
<br /> vacating of the herein described street and alley were heard and discussed,
<br /> and
<br /> WHEREAS, it now appears to the City Council that said petition should
<br /> be ;ranted subject to certain reservations and exceptions and said City Council
<br /> does hereby determine to vacate the above described street and alley subject to
<br /> certain reservatas and exceptions.
<br /> NOW, THEREFORE, THE CITY OF EVERETT D0ES ORDAIN:
<br /> Section 1: That the street and alley in ;the City of Everett, County
<br /> of Snohomish, State of Washington, described as follows, to-wit :
<br /> Rainier Drive from the south line of Lot 22, Block 6, Beverly Hills
<br /> Division No. 2, north to the s >uth line of Lake Street
<br /> be and the same is hereby vacated subject to the following conditions,
<br /> restrictions and reservatione The City of Everett retains an easement to
<br /> construct, operate, maintain, repair, replace and add thereto, all public utilities,
<br /> and to grant the construction, operation and maintenance of other public utilities,
<br /> including but not limited to telephone, gas, electricity, and conditioned further
<br /> that no structures of any permanent natuee shafrbre constructed over said street
<br /> and alley vacated.
<br /> Section 2: That an eat ency is hereby declared to exist and this
<br /> ordinance shall take effect upon passage and publication.
