LICENSE TO USE CITY PROPERTY <br /> THIS LICENSE AGREEMENT (the"License"),between City of Everett as Grantor <br /> (the"CITY") and INTERWEST Construction, Inc., 609 N Hill Blvd.,Burlington, WA <br /> 98233 as the Grantee ("INTERWEST"),relates to an approximately 3-acre portion of <br /> property owned by the CITY located at 2000 block of Norton Ave,Everett, WA(the <br /> "Property"). <br /> RECITALS <br /> A. INTERWEST desires to utilize property owned by the CITY for <br /> temporary staging/placement of construction equipment/materials. <br /> B. CITY is willing to grant INTERWEST authority to use CITY's property <br /> upon certain terms and conditions. <br /> AGREEMENT <br /> In consideration of mutual benefits and other good and valuable consideration,the receipt <br /> and sufficiency of which is hereby expressly acknowledged, CITY licenses <br /> INTERWEST to use the Property upon the following terms and conditions: <br /> Section 1. LICENSED PROPERTY. The specific area of Property owned by <br /> CITY, and subject to this License, is an approximately 3-acre area and is more fully set <br /> forth as depicted in Exhibit A,attached hereto. <br /> Section 2. TERM. This License shall be effective beginning September 1,2019, and <br /> shall expire on February 29,2020, unless terminated earlier upon 30-days' notice per <br /> Section 7,below. Any tenancy after the initial term shall be month to month. <br /> Section 3. MONTHLY CONSIDERATION. INTERWEST shall pay Three- <br /> Thousand Three Hundred Dollars($3,300.00),the equivalent of$1,100.00 per acre, due <br /> each month on or before the 1St day of each month during the term of this License plus <br /> Lease Hold Tax at a rate of 12.84%, if applicable. <br /> Section 4. AUTHORIZED USE. INTERWEST may only use the Property for the <br /> purpose of temporary staging/placement of construction equipment/materials. <br /> Section 5. INDEMNIFICATION. INTERWEST hereby agrees to defend, <br /> indemnify and hold CITY harmless from any and all Claims for injury to people or <br /> damage to property arising out of or related to this License. This defense and <br /> indemnification obligation shall survive any termination, revocation or expiration of this <br /> Agreement.
