Interwest Construction Inc Use of City Property 10/2/19

LICENSE TO USE CITY PROPERTY THIS LICENSE AGREEMENT (the"License"),between City of Everett as Grantor (the"CITY") and INTERWEST Construction, Inc., 609 N Hill Blvd.,Burlington, WA 98233 as the Grantee ("INTERWEST"),relates to an approximately 3-acre portion of property owned by the CITY located at 2000 block of Norton Ave,Everett, WA(the "Property"). RECITALS A. INTERWEST desires to utilize property owned by the CITY for temporary staging/placement of construction equipment/materials. B. CITY is willing to grant INTERWEST authority to use CITY's property upon certain terms and conditions. AGREEMENT In consideration of mutual benefits and other good and valuable consideration,the receipt and sufficiency of which is hereby expressly acknowledged, CITY licenses INTERWEST to use the Property upon the following terms and conditions: Section 1. LICENSED PROPERTY. The specific area of Property owned by CITY, and subject to this License, is an approximately 3-acre area and is more fully set forth as depicted in Exhibit A,attached hereto. Section 2. TERM. This License shall be effective beginning September 1,2019, and shall expire on February 29,2020, unless terminated earlier upon 30-days' notice per Section 7,below. Any tenancy after the initial term shall be month to month. Section 3. MONTHLY CONSIDERATION. INTERWEST shall pay Three- Thousand Three Hundred Dollars($3,300.00),the equivalent of$1,100.00 per acre, due each month on or before the 1St day of each month during the term of this License plus Lease Hold Tax at a rate of 12.84%, if applicable. Section 4. AUTHORIZED USE. INTERWEST may only use the Property for the purpose of temporary staging/placement of construction equipment/materials. Section 5. INDEMNIFICATION. INTERWEST hereby agrees to defend, indemnify and hold CITY harmless from any and all Claims for injury to people or damage to property arising out of or related to this License.
