CITY <br /> RIGHT-OF-ENTRY AGREEMENT <br /> for Haack Brothers Inc. <br /> REAL ESTATE MANAGER PROJECT:Legion Lots <br /> 3200 CEDAR STREET SITE ADDRESS:400 Block of Rockefeller Ave <br /> EVERETT,WA 98201 <br /> This agreement made this i5 day of NO✓• ,2019,by and between the City of Everett, <br /> (hereinafter referred to as"City or Grantor")who hereby grants permission to Haack Brothers <br /> Inc,3922 87th Ave NE,Marysville,WA 98270(Attn:Joel Haack,ph:425-397- <br /> 7360 email: joel@haackbrothers.com, (hereinafter referred to as"Grantee"),to enter upon <br /> certain lands in donation of mutual benefits for the purposes of access for soils assessment. The <br /> land to which this right-of-entry agreement applies is the City owned properties commonly <br /> identified as Snohomish County Tax Parcel Number: 00438610400600(hereinafter referred to as <br /> "Property"). <br /> The Grantor and Grantee, by granting and accepting this right-of-entry agreement respectively, <br /> mutually covenant and agree as follows: <br /> 1. The Grantee and or its authorized agents or subcontractors will make reasonable efforts to <br /> minimize disruption and inconvenience to said property and uses made thereof. <br /> 2. This right-of-entry agreement will become null and void at such time as the Grantee has <br /> completed the soils assessment work or on December 15,2019,whichever occurs first. <br /> 3. The Grantee shall remove all debris and restore the surface of the property as nearly as possible <br /> to the condition immediately prior to the Grantee's entry thereon. <br /> 4. Except as otherwise provided in this paragraph, the Grantee hereby agrees to defend and <br /> indemnify the Grantor from any and all Claims arising out of, in connection with, or incident <br /> to any acts, errors,omissions,or conduct by Grantee(or its employees,agents,representatives <br /> subcontractors/subconsultants) relating to this Agreement.
