• <br /> • <br /> ORDINANCE NO. 4°15 <br /> AN ORDINANCE providing for the vacating of the following <br /> described portion of alley in the City of Everett, County of <br /> Snohomish, State of Washington, to-wit: <br /> The alley south of Pacific Ave. , in Block 74+2, <br /> Everett Land Company' s First Add. from Broadway <br /> east for 119.87 ft. to the west line of the <br /> alley west of McDougal Avenue. <br /> it WHEREAS, the owners of more than two-thirds of the <br /> ! private property abutting upon the portion of street and alley <br /> I above described have duly filed their petition with the City <br /> 1! Council of Everett praying for the vacation of said portion of <br /> street and alley, and <br /> WHEREAS, said City Council of the City of Everett did <br /> i by resolution duly adopted, fix the 7th day of May, 1964, at <br /> 10:00 A.M. of said day for the hearing and determination of said <br /> petition, and <br /> WHEREAS, due and legal notice of the time and place of <br /> said hearing and the determination of said petition has been <br /> given by the City Clerk in the manner prescribed by law, and <br /> • WHEREAS, at the time and place fixed for hearing objec- <br /> tions to the vacating of the herein described portion of street <br /> and alley were heard and discussed, and <br /> WHEREAS, it now appears to the City Council that said <br /> petition should be granted subject to certain reservations and <br /> exceptions and said City Council does hereby determine to vacate , <br /> the above described portion of said street and alley subject to <br /> certain reservations and exceptions . <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: That the portion of street and alley in the <br /> City of Everett, County of Snohomish, State of Washington, <br /> described as follows, to-wit: <br /> The alley south of Pacific Avenue in Block <br /> 74+2, Everett Land Company' s First Addition <br /> from Broadway east for 119.87 feet to the <br /> west line of the alley west of McDougal Avenue, <br /> ' be, and the same is hereby vacated subject to the following <br /> conditions and reservations: The City of Everett reserves and <br /> retains an easement to construct, operate, replace, repair and <br /> maintain municipal utilities under, over and across said portion <br /> vacated as above described. <br /> MAR <br /> Attest: <br /> . <br /> t Clerk <br /> Passed: JUN 9 1964 <br /> JUN 31964 <br /> Published: <br />
