LICENSE TO USE CITY PROPERTY <br /> THIS LICENSE AGREEMENT (the "License"), between the City of Everett as Grantor (the <br /> "City") and Jason L. White and Heather Elliott, as Grantee ("Grantee"), for use of City <br /> owned property. <br /> RECITALS <br /> A. Grantee desires to utilize property owned by the City for cutting hay <br /> and related agricultural purposes. No earthwork or permanent <br /> structures of any kind are permitted. <br /> B. The City is willing to grant Grantee authority to use City property for <br /> certain terms and conditions. <br /> AGREEMENT <br /> In consideration of mutual benefit to the city and other good and valuable <br /> consideration, the receipt and sufficiency of which is hereby expressly acknowledged, <br /> the City licenses Grantee to use the Property upon the following terms and conditions: <br /> Section 1. LICENSED PROPERTY. A Portion of that property legally described as <br /> (abbreviated legal): <br /> SEC 05 TWP 28 RGE 05RT-34) BEG SE COR SEC 5 TH W 15 CH TH N 20 CH <br /> M/L TO N LN SE1/4 SE1/4 TH E 15 CH TH S TO POB <br /> The area of use is approximately 22.2 acres as generally depicted on Exhibit "A" <br /> attached hereto and included herein by reference. <br /> Section 2. TERM. This License shall be effective July 6, 2020 through June 30, 2021 <br /> unless terminated earlier upon 30-days notice per Section 6, below. Thereafter, this <br /> license shall continue on a month to month basis subject to a 30-day notice period for <br /> termination. <br /> Section 3. AUTHORIZED USE. Grantee may only use the Property for cutting hay <br /> and related agricultural purposes. <br /> Section 4. INDEMNIFICATION. Grantee hereby agrees to defend, indemnify and <br /> hold the City harmless from any and all Claims for injury to people or damage to <br /> property arising out of or related to this License.
