<br /> and wife,4465.00.,for right of way for Sultan Dine 42.be allowed and

<br /> Moved by Rasmussen,as coded by Martin,that the proposal of R.M.
<br /> Moore,for the completionof Section 6,Sultan River Prcjeet 42,in the
<br /> cum of 460,600.00,supplemented by his letter of Larch 25th,be accepted
<br /> as the lowest and beat bid,and that the Mayor and the City Clerk be
<br /> authorized to sign and execute the contxaot upon the filing and approval

<br /> V With reference to the bond of the Moran Cooetruetlon Company,at
<br /> principal,and the undersigned,se suretyydated_Dacember 16,1929,the
<br /> Moran Construction Company,having been defaulted,and the undersigned
<br /> having elected not to 0®plete,and the City-of Everett preceeding to
<br /> oempiete the word contemplated by the contract of the Moran Construct-
<br /> ion Company,it is represented to the undersigned that the City of
<br /> Everett propoeee to use the machinery,equipment,plant,tools,mater-
<br /> ials end supplies on hand,other than rented equipment,and that the
<br /> City desires the consent oI the undersigned that it use such machinery,
<br /> etc.in such completion.
<br /> Thio,therefore,confirms that the u:Werelgned eoneenta that.in
<br /> completing said contract,the City of Bverett,or any contractor employ-
<br /> ed by it,may use the machinery,equipment.punt,tools,materials and
<br /> suppliee of in-
<br /> cluding rantedd belonging to the Moran Const,ho en Company(not in-
<br /> equllmedth,and consents that,In event the Moran Con-
<br /> of Everett
<br /> Company shall he'taafternobtain any eudeme of against the City
<br /> of Everett for damages aacgeaned by it for the use of such machinery,
<br /> equipment,etc.,such damages may be charged to the costs of eto the-
<br /> ing said contxaot.and shall be a part of the cost tchargeableoithto he
