339 • <br /> August 22,1984 <br /> The regular meeting of the Everett city Council was called to order <br /> at 8:30 a.m., August 22, 1984, in the Council Chambers of the <br /> Everett City Hall,President Stephenson presiding. 1/Pon rell call <br /> it was found that Mayor Moore and all Councilmen were in attendance. <br /> :11/=.of the meeting held August 15, 1984, were approved as <br /> MAYOR'S COME-NTS <br /> • <br /> • Mayor Moore said he had received a requeet to announce to the <br /> Council that a new business entitled Consolidated Freightwaye,was. <br /> opening up in Everett in the 3100 block of McDougal to serve the <br /> COUNCILMEN COMMENTS <br /> Councilman Pope spoke of the third public hearing on the Navy issue <br /> at the Courthouse Monday night. He said a workshop would be held on <br /> August 29, 1984 to discuss the Council's thoughts on their various <br /> visits to Naval installations and hopefully a decision would be made.. <br /> September 5th as to the advisory vote. • <br /> ATTORNEY'S COMMENTS <br /> Bruce dones, City Attorney, said that Councilman Michelsori had <br /> inquired concerning how the duties of councilpersons relating to the <br /> . HaVy home port issue may affect a councilperson's right to support <br /> Or OPP...or Maks anY position on the Navy home port issue. He said <br /> the most significant City of Everett action regarding the Navy <br /> facility is the shoreline management permit. The State Shoreline <br /> Act applies where federal facilities are-located on leased,land. 1 <br /> The shoreline permit process requires Planning Commission review and <br /> recommendation and City Council action on projects of over 5 acres. <br /> Mr.Jones cc id hearing and granting a shoreline permit is a quasi- <br /> Judicial action. Although the appearance of fairness teat <br /> Ordinarily doesn't apply until the application is filed, <br /> quasi-Judicial officers should not taint the proceedings by obvious <br /> PrejudgeMent or interference with the right to a fair heating. <br /> Accordingly,he recommended that all Councilmen refrain from taking <br /> a position on the Navy home port issue. <br /> • <br /> Ea said realizing the difficulties inherent in such restraint on an <br /> issue of City wide importance, he suggested that the City Council <br /> might consider modifying the shoreline management hearing procedures <br /> so that ell PerMft applications are heard by the Hearing Examioer or <br /> Possibly all applications by federal agencies or fedarel or state 1 <br /> agencies. <br /> • <br /> • <br /> . 1 <br /> .• - <br />
