EVERETT <br /> WASHINGTON <br /> ORDINANCE NO. 3778-20 <br /> An Ordinance Relating to the Chaplain Tract, amending Ordinance No. 3315-13. <br /> WHEREAS, <br /> A. Protection of water quality in the Chaplain Tract, as well as within the entire Sultan Basin, are of <br /> paramount importance to the City's ability to provide adequate safe drinking water to those in its <br /> service area and to protect important resources; and <br /> B. The City of Everett provides domestic drinking water to approximately 75 percent of Snohomish <br /> County; and <br /> C. The Washington State Board of Health Drinking Water Regulations require that water purveyors <br /> obtain drinking water from the highest quality source feasible, with purveyors obligated to <br /> identify and monitor those conditions and activities which adversely affect source water quality <br /> and make recommendations for improved watershed control (WAC 246-290-668); and, <br /> D. The City passed a major update to the Chaplain Tract ordinance in 2013 under Ordinance No. <br /> 3315-13; and <br /> E. Minor updates to the ordinance are necessary to preserve water quality and regulate public <br /> access in those areas of Chaplain Tract where it is permitted. <br /> NOW,THEREFORE,THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1. Section 05 of Ordinance 3315-13 (codified at EMC 8.64.050), is amended as follows, <br /> with strikeout text deleted and underlined text added: <br /> A. Chaplain Tract North—No Public Access. No person shall knowingly enter or remain, unless <br /> authorized, on lands described as Chaplain Tract North or in or upon Chaplain Reservoir and its <br /> shoreline. <br /> B. Chaplain Tract South—Restricted Public Access. No person shall knowingly enter or remain, <br /> unless authorized, on lands described as Chaplain Tract South between 6:00 p.m. and 6:00 a.m. <br /> every day of the week. The gate located at the south end of Lake Chaplain Road (approximately <br /> four miles south of the city filtration plant)will be locked between the hours of 6:00 p.m. and 6:00 <br /> a.m. <br />
