• <br /> ORDINANCE NO. .32 ;, <br /> AN ORDINANCE REGULATING THE SALE OF FIREWORKS IN THE <br /> CITY OF EVERETT, DEFINING FIREWORKS, AND PROHIBITING THE SALE OF <br /> CERTAIN TYPES OR KINDS OF FIREWORKS, PROVIDING FOR THE ISSUANCE <br /> OF PERMITS FOR THE SALE OF FIREWORKS, APPROVED OR BEARING THE <br /> "SEAL OF REGISTRATION" OF THE OFFICE OF THE FIRE MARSHAL OF THE <br /> STATE OF WASHINGTON; FIXING MINIMUM STANDARDS AND CONDITIONS FOR <br /> THE CONSTRUCTION OR USE OF TEMPORARY FIREWORKS STANDS; PROVIDING <br /> FOR MINIMUM CONDITIONS GOVERNING THE HANDLING, STORING AND <br /> DISPENSING OF FIREWORKS; AUTHORIZING THE SALE AND USE OF FIRE- <br /> WORKS WITHIN THE CORPORATE LIMITS OF THE CITY OF EVERETT FROM <br /> JUNE 28 TO JULY 6 OF EACH CALENDAR YEAR; AND REPEALING A PORTION <br /> OF ORDINANCE NO. 1599, SECTION 1, AS AMENDED, BEING EVERETT CITY <br /> CODE 6.08.130; REPEALING ORDINANCE NO. 3505, BEING EVERETT CITY <br /> CODE 6.22 .010 and .020; REPEALING ARTICLE 12 OF THE FIRE PRE- <br /> VENTION CODE OF THE CITY OF EVERETT, BEING A PORTION OF ORDINANCE <br /> NO. 3697, EVERETT CITY CODE 7.04.010, AND ALL OTHER ORDINANCES <br /> OR PARTS OF OR 7INANCES IN CONFLICT THEREWITH; AND PROVIDING. PENAL S <br /> FOR THE VIOLATION THEREOF. <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: "Repeal of Existing Ordinances": The follow- <br /> ing ordinances or portions of ordinances are hereby repealed, <br /> namely: <br /> Ordinance No. 3503, being Everett City Code 6.22 .010 <br /> 6.22 .020; <br /> Everett City Code, Section 6.08.130, which is a <br /> portion of Section 1 of Ordinance No . 1599 as <br /> amended; <br /> Article 12, being Sections 12 .01 through 12 .05 of <br /> the suggested Fire Prevention Ordinance as <br /> adopted by Ordinance No. 3697 (Everett City <br /> Code 7.04.010, but just repealing Article 12 <br /> and the sections thereunder) . <br /> Section 2 : "Definitions": The definitions set forth in <br /> this Ordinance shall govern the construction of this ordinance, <br /> under the Washington State Fireworks Law, being Chapter 228 of <br /> the Laws of 1961, R.C .W. 70.77 et seq. , shall further govern the <br /> construction of this ordinance, unless otherwise provided or set <br /> forth herein. This ordinance not intended to implement said <br /> Washington State Fireworks law as shall be construed in connect- <br /> ion therewith, and any and all rules and regulations issued <br /> pursuant thereto. <br /> Section 3: "Fireworks": "Fireworks" means blank <br /> cartridges, toy pistols, toy cannons, toy canes or toy guns in <br /> which explosives are used, fire balloons (balloons of a type <br /> which have burning material of any kind attached thereto or which <br /> require fire underneath to propel them) , firecrackers, torpedoes, <br /> skyrockets, rockets, Roman candles, daygo bombs, or other fire- <br /> works of like construction and any fireworks containing any com- <br /> bustible or explosive substance for the purpose of producing a I <br /> visible or audible effect by combustion, explosion, deflagration,' <br /> or detonation, but does not include toy pistols, toy canes, toy <br /> guns, or other similar devices in which paper caps containing <br /> not more than twenty-five hundredths grain of explosive compound <br /> per cap are used. Nothing herein shall be deemed to prohibit the <br /> use of any explosive or flammable compound, blasting caps and <br /> similar items used for industrial purposes . <br />
