• ORDINANCE NO. .32 ;, AN ORDINANCE REGULATING THE SALE OF FIREWORKS IN THE CITY OF EVERETT, DEFINING FIREWORKS, AND PROHIBITING THE SALE OF CERTAIN TYPES OR KINDS OF FIREWORKS, PROVIDING FOR THE ISSUANCE OF PERMITS FOR THE SALE OF FIREWORKS, APPROVED OR BEARING THE "SEAL OF REGISTRATION" OF THE OFFICE OF THE FIRE MARSHAL OF THE STATE OF WASHINGTON; FIXING MINIMUM STANDARDS AND CONDITIONS FOR THE CONSTRUCTION OR USE OF TEMPORARY FIREWORKS STANDS; PROVIDING FOR MINIMUM CONDITIONS GOVERNING THE HANDLING, STORING AND DISPENSING OF FIREWORKS; AUTHORIZING THE SALE AND USE OF FIRE- WORKS WITHIN THE CORPORATE LIMITS OF THE CITY OF EVERETT FROM JUNE 28 TO JULY 6 OF EACH CALENDAR YEAR; AND REPEALING A PORTION OF ORDINANCE NO. 1599, SECTION 1, AS AMENDED, BEING EVERETT CITY CODE 6.08.130; REPEALING ORDINANCE NO. 3505, BEING EVERETT CITY CODE 6.22 .010 and .020; REPEALING ARTICLE 12 OF THE FIRE PRE- VENTION CODE OF THE CITY OF EVERETT, BEING A PORTION OF ORDINANCE NO. 3697, EVERETT CITY CODE 7.04.010, AND ALL OTHER ORDINANCES OR PARTS OF OR 7INANCES IN CONFLICT THEREWITH; AND PROVIDING. PENAL S FOR THE VIOLATION THEREOF. NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: "Repeal of Existing Ordinances": The follow- ing ordinances or portions of ordinances are hereby repealed, namely: Ordinance No. 3503, being Everett City Code 6.22 .010 6.22 .020; Everett City Code, Section 6.08.130, which is a portion of Section 1 of Ordinance No . 1599 as amended; Article 12, being Sections 12 .01 through 12 .05 of the suggested Fire Prevention Ordinance as adopted by Ordinance No. 3697 (Everett City Code 7.04.010, but just repealing Article 12 and the sections thereunder) . Section 2 : "Definitions": The definitions set forth in this Ordinance shall govern the construction of this ordinance, under the Washington State Fireworks Law, being Chapter 228 of the Laws of 1961, R.C .W. 70.77 et seq. , shall further govern the construction of this ordinance, unless otherwise provided or set forth herein. This ordinance not intended to implement said Washington State Fireworks law as shall be construed in connect- ion therewith, and any and all rules and regulations issued pursuant thereto. Section 3: "Fireworks": "Fireworks" means blank cartridges, toy pistols, toy cannons, toy canes or toy guns in which explosives are used, fire balloons (balloons of a type which have burning material of any kind attached thereto or which require fire underneath to propel them) , firecrackers, torpedoes, skyrockets, rockets, Roman candles, daygo bombs, or other fire- works of like construction and any fireworks containing any com- bustible or explosive substance for the purpose of producing a I visible or audible effect by combustion, explosion, deflagration,' or detonation, but does not include toy pistols, toy canes, toy guns, or other similar devices in which paper caps containing not more than twenty-five hundredths grain of explosive compound per cap are used. Nothing herein shall be deemed to prohibit the use of any explosive or flammable compound, blasting caps and similar items used for industrial purposes .
