I <br /> ORDINANCE No. <br /> AN ORDINANCE providing for the vacation of the following <br /> described portion of street in the City of Everett , County of <br /> Snohomish , State of Washington, to-wit : <br /> 9th Street from the alley between Oakes Avenue <br /> and Rockefeller Avenue to fakes Avenue ; and <br /> WHEREAS, the owners of more than two-thirds of the private <br /> property abutting upon the portion of street above described have <br /> duly filed their petition with the City Council of Everett praying <br /> for the vacation of said portion of street; and <br /> WHEREAS, said City Council of the City of Everett , did by <br /> resolution duly adopted, fix the 15th day of October, 1947, at <br /> 10:00 o'clock A.M. , of said day for the hearing and determination <br /> of said petition ; and <br /> WHEREAS, due and legal notice of the time and place of <br /> said hearing and the determination of said petition has been given <br /> by the City Clerk in the manner required by law; and <br /> WHEREAS, at the time and the place fixed for hearing, no <br /> persons appeared or made objections to the vacating of the herein <br /> described portion of street and no objections of any kind were made <br /> to the granting of said petition; and <br /> WHEREAS, it now appearing to the City Council that said <br /> petition should be granted and said Council does hereby determine <br /> to vacate the above described portion of street, <br /> NOW, THEREFORE , THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: That the portion of street in the City of <br /> Everett, County of Snohomish, State of Washington, described as <br /> follow4 to-wit : <br /> 9th Street from the alley between Oakes Avenue <br /> and Rockefeller Avenue to Oakes Avenue <br /> be , and the same is hereby vacated and the title to the land in said <br /> portion of street, above described, is hereby declared to vest in <br /> the abutting property owners as provided by law. <br /> kdayo r <br /> ATTEST: <br /> 3 <br /> j/..i4 <br /> r 1 C'ty Clerk <br /> Passed: October. 28th , 194' . <br /> Published - November 1st, <br />
