ORDINANCE NO. 3144 . An Ordinance providing for the improvement of the alley west of Broadway from a point 193.14 feet south of the south property, line of 39th Street extended westerly in its present direction, to a point 140 feet north of the north property line of 39th Street extended westerly in its present direction, thence northerly to a connection with an existing sewer constructed by the School District, by the construction of a sewer and its necessary appur- tenances and by doing all other work necessary to make a complete improvement, all in accordance with Resolution No. 5236 of the City of Everett ; creating a local improvement district; cr•e-+.ting a local improvement district fund therefor ; providing for the payment of said improvement to be made by special assessment to the property in said district under the mode of payment by bonds, and WHEREAS, by Resolution No. 5236 the City Council of the City of Everett has declared its intention to order the improvement as above outlined, and to do all work in connection therewith to make a complete improvement in accordance with the plans and specifica- tions as prepared by the City Engineer of the City of Everett ; and WHEREAS, the cost of improvement may exceed the assessed value of the property, less improvements, and less outstanding unpaid local improvement assessments; and WHEREAS, the City Council has by unanimous vote held the improvement to be necessary for the public health ana benefit and has ordered the same. NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: That the City Council of Everett, by unanimous vote, finds the improvement herein described to be necessary for the public health and benefit and so orders the improvement. Section 2: That the alley West of Broadway from a point 193.14 feet south of the south property line of 39th Street extended westerly in its present direction, to a point 14U feet north of the north property line of 39th Street extended westerly in its present direction, thence northerly to a connection with an existing sewer constructed by the School District, be improved by the con- struction of a sewer and its necessary appurtenances and by doing all other work necessary to make a complete improvement, all in accordance with. the plans and specifications prepared under the direction of the Engineer of the City of Everett, which plans and specifications are hereby approved and adopted. Section 3: That the cost and expense of such improvement, including all necessary incidental expense, shall be borne by and assessed against the property included in the assessment district herein created in accordance with the special benefits conferred without regard to the zone ana termini method. The City of Everett shall not be liable in any manner for any portion of the costs and expenses of such improvement, except as provided by Chapter 141, Session Laws of 1923, or acts amendatory thereto, and the Ordin- ances of the City of Everett.
