1 t 4 • ORDINANCE NO. 3143 • AN ORDINANCE providing for the improvement of 34th Street from Snohomish Avenue to Kromer Avenue , Bell Avenue from 34th Street to 35th Street , Tulalip Avenue from 33rd Street to 34th Street , Niles Avenue from Laurel Drive to Tulalip Avenue , and Kromer Avenue from 33rd Street to 35th Street , by the construction of a Portland cement concrete pavement, necessary sidewalks, installation of necessary water mains , and by doing all other work necessary to make a complete improvement , all in accordance with Resolution No. 5230 of the City of Everett ; creating a local improvement district ; creating a local improvement district fund therefor; pro- viding that fifty per cent ( 50%) of the cost of that portion of the improvement involving grading , construction of surfacing and pavement and engineering expense shall be paid b the funds from the Washington State Development Board, and the balance of the cost of said improvement shall be borne by and assessed against the property liable therefor in said district under the mode of pay- ment by bonds. WHEREAS, by Resolution No. 5230 the City Council of the City of Everett has declared its intention to order the improve- ment as above outlined, and doing all work in connection therewith to make a complete improvement in accordance with the plans and specifications as prepared by the City Engineer of the City of Everett . NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: That 34th Street from Snohomish Avenue to Kromer Avenue , Bell Avenue from 34th Street to 35th Street, Tulalip Avenue from 33rd Street to 34th Street, Niles Avenue from Laurel Drive to Tulalip Avenue , and Kromer Avenue from 33rd Street to 35th Street be paved with Portland cement concrete pavement and including as a part of such work the construction of necessary sidewalks , installation of necessary water mains , and by doing all other work necessary to make a complete improvement , all in ac- cordance with the plans and specifications prepared under the directionof the City Engineer and rich plans and specifications are hereby adopted and approved. Section 2 : That the cost and expense of such improve- ment including all necessary and incidental expenses , shall be borne as follows: Fifty per cent ( 50%) of the cost of that portion of the improvement involving grading, construction of surfacing and pavement and engineering expense shall be paid by funds from the Washington State Development Board, the remaining cost of said improvement shall be borne by and assessed against the property liable therefor in the district herein created in accordance with law. The City of Everett shall not be liable in any manner for any portion of the costs and expenses of such improvement except as provided by Chapter 141 Session Laws of 1923 , or acts amendatory thereto and the ordinances of the City of Everett . - 1 -
