r • ORDINANCE NO. 3111. i AN ORDINANCe regulating the use of sound amplifying instruments in the City of Everett ; providing for permit thereof ; providing penalties for violation thee of; repealing Ordinance No.2694 of the City of Everett ; and declaring an emergency. THE CITY OF EVER. TT DOES ORDAIN?: Section 1: The purpose of this ordinance is to regulate the use of sound amplifying instruments so that their use shall not constitute a nuisance or shall in any way endanger the peace and cuiet of the City of Everett. Section 2: The term "sound amplifying instruments" as used herein shall mean and include every device or apparatus for the amplification of the human voice, or any other sounds , - iionograph or other recordings . This ordinance shall not apply to sound amplifying instruments used or operated within the confines of a building or structure and where such instrumen' is not audible to the public outside said building or structure . This ordinance shell • not apply to private radios operated upon private property as long as their use shall not constitute a nuisance . This ordinance shall not apply to radios operated in private motor vehicles. Sectioi 3: It shall be unlawful for any person, firm, corporation or association to operate or cause to be operated in the city of Everett any sound amplifying instrument without having obtained a permit therefor, and except and in • accordance with. the terms of this ordinance . Section 4: Any person, firm, corporation or association desiring to operate a sound amplifying instrument shall first make application for such permit with the City Clerk by filing therewith a written statement of the time , place and duration of such operation of said sound amplifying instrument, together with the applicant 's name and address . Such application must be filed at least Three (3) days before the first date of operation as requested. The City Clerk shall then present said application to • the City Council, and the City Council may issue a permit therefor . for such time and on such conditions es may be deemed proper. Such permit shall be revocable by the City Council at any time upon • notice to the applicant either in writing or oral . The decision of. the City Council shall be final. Section 5: Any person violating any provisions of this ordinance shall, upon conviction thereof, be punished by a fine not exceeding One Hundred ($100 .00) Dollars, or by imprisonment in the City Jail not exceeding Thirty (30) days, or oy both such fine and imprisonment. • • • • - 1 -
