• ORDINANCE NO. 3106 . j, An Ordinance providing for the improvement of the alley between Colby Avenue and Hoyt Avenue from 36th Street to 37th Street by paving the same with Bituminous Plant iix Class "F", by providing for the necessary surface drainage, by doing such grading or re- grading as may be necessary and such other work be done that maybe necessary in connection therewith to make a complete improvement; in accordance with a majority petition they efor ; creating an assessment district; creating a local improvement district fund therefor, and providing for the payment of saia improvement by special assessment on the property in said district under the mode of payment by bongs. , ereas, there has been heretofore filed with the City Council of the City of Lverett a majority petition of the property owners petitioning for said improvement, and upon examination thereof the said City Council has found the things set forth therein to be true; and whereas, the said Petition has been referred to the Commissioner of Public Vorks to be examined by said Commissioner and the City Engineer, and the Commissioner of Public Works has filed with the City Council all data and information requir< d by law; and ",hereas, said Commissioner of Public 1+ ors has recoemended to the City Council that said improvement petitioned for be made, and it appearing to the City Council that the public health, convenience and necessity require that such improvement be made. NO10, THrEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1 : That the alley between Colby Avenue and Hoyt Avenue from 36th Street to 37th Street be improved by paving the same with Bituminous Plant lr! .x Class "F", by providing for the necessary surface drainage, by doing such grading or regrading as may be necessary and such other work be done that may be necessary in connection therewith to make a complete improvement, all accoranng to the plans and specifications prepared under the direction of the City Engineer, and which plans and specifications are hereby adopted and approved. Section 2: That the cost and expense of such improvement, including all necessary incidental expense, shall be borne by ana assessed against the property included in the assessment district herein created in accordance with law. The City of Everett shall not be liable in any manner for any portion of the costs and expenses of such improvement except as provided by Chapter 141 Session Laws of 1923, or acts amendatory thereto and the ordinances of the City of yverett. Section 3: That there is hereby established a local improvement district to be known as "Local Improvement District No. _578 , " which district shall include the following described property located in Lverett, enohomish County, ashington, to-wit: Lots 1 to 32 inclusive, Block 11, i`rid_ay' s First Addition to Everett.
