• <br /> ORDINANCE NO. 3106 . <br /> j, An Ordinance providing for the improvement of the alley <br /> between Colby Avenue and Hoyt Avenue from 36th Street to 37th Street <br /> by paving the same with Bituminous Plant iix Class "F", by providing <br /> for the necessary surface drainage, by doing such grading or re- <br /> grading as may be necessary and such other work be done that maybe <br /> necessary in connection therewith to make a complete improvement; in <br /> accordance with a majority petition they efor ; creating an assessment <br /> district; creating a local improvement district fund therefor, and <br /> providing for the payment of saia improvement by special assessment <br /> on the property in said district under the mode of payment by bongs. <br /> , ereas, there has been heretofore filed with the City <br /> Council of the City of Lverett a majority petition of the property <br /> owners petitioning for said improvement, and upon examination <br /> thereof the said City Council has found the things set forth therein <br /> to be true; and <br /> whereas, the said Petition has been referred to the <br /> Commissioner of Public Vorks to be examined by said Commissioner <br /> and the City Engineer, and the Commissioner of Public Works has <br /> filed with the City Council all data and information requir< d by <br /> law; and <br /> ",hereas, said Commissioner of Public 1+ ors has recoemended <br /> to the City Council that said improvement petitioned for be made, <br /> and it appearing to the City Council that the public health, <br /> convenience and necessity require that such improvement be made. <br /> NO10, THrEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1 : That the alley between Colby Avenue and Hoyt <br /> Avenue from 36th Street to 37th Street be improved by paving the <br /> same with Bituminous Plant lr! .x Class "F", by providing for the <br /> necessary surface drainage, by doing such grading or regrading as <br /> may be necessary and such other work be done that may be necessary <br /> in connection therewith to make a complete improvement, all accoranng <br /> to the plans and specifications prepared under the direction of the <br /> City Engineer, and which plans and specifications are hereby adopted <br /> and approved. <br /> Section 2: That the cost and expense of such improvement, <br /> including all necessary incidental expense, shall be borne by ana <br /> assessed against the property included in the assessment district <br /> herein created in accordance with law. The City of Everett shall <br /> not be liable in any manner for any portion of the costs and expenses <br /> of such improvement except as provided by Chapter 141 Session <br /> Laws of 1923, or acts amendatory thereto and the ordinances of the <br /> City of yverett. <br /> Section 3: That there is hereby established a local <br /> improvement district to be known as "Local Improvement District <br /> No. _578 , " which district shall include the following described <br /> property located in Lverett, enohomish County, ashington, to-wit: <br /> Lots 1 to 32 inclusive, Block 11, i`rid_ay' s First <br /> Addition to Everett. <br />
