1 o I ORDINANCE NO. 3102 1 I AN ORDINANCE providing for the improvement of the alley between Grand Avenue and Rucker Avenue from 22nd Street to 23rd Street by grading to proper grade , construction of a Portland cement concrete pavement , installation of necessary drainage , end by doing all other wore- necessary to make a complete improvement ; in accordance with a majority petition therefor; creating an assessment district; creating a local improvement district fund therefor, and providing for the payment of said improvement by special assessment on the property in said district under the mode or payment by bonds. 'r REAS, there has been heretofore filed with the City • Council of the City of Everett a majority petition of the property ' owners petitioning for said improvement , and upon examination there- I of the said City Council has found the things set forth therein to be true; and WHEREAS, the said Petition has been referred to the Commis- sioner of Public Works to be examined by said Commissioner and the City Engineer, and the Commissioner of Public Works has filed with the City Council all data and information required by law; and WHEREAS, said Commissioner of Public Works has recommended . to the City Council that said improvement petitioned for be made , and it appearing to the City Council that the public Health, con- venience and necessity require that such improvement be made . NOW, THEREFORE, THE CIT-' OF EVT:ERETT DOES ORDAIN: Section l: That the alley between Grand Avenue and Rucker Avenue from 22nd Street to 23rd Street be improved by grading to proper grade , construction of a Portlana cement concrete pavement , installation of necessary drainage , and by doing all other work necessary to make a complete improvement , all according to the plans and specifications prepared under the direction of the City Engineer, and which plans and specifications are hereby adopted and approved. • Section 2 : That the cost end expense of such improvement, including all necessary incidental expense, shall be borne by and assessed against the property included in the assessment district herein created in accordance with law. The City of Everett shall not be liable in any manner for any portion of the costs and expenses of such improvement except as provided by Chapter 141 Session Laws of 1923, or acts amendatory thereto and the ordinances of the City of Everett . Section 3: That there is hereby established a local improvement district to be known as "Local Improvement District ' Nc . 576 , " which district shall include the following described property located in Everett , Snohomish County, y'fashington, to-wit: II. Lots One (1) to Thirty-two ( 32) inclusive, Block Four Hundred -Eighty Two (482) , Plat of Everett. - 1 -
