ORDINANCE No. 3C86 AN ORDINANCE providing for the improvement of the Alley East of T rrace Drive , from 43rd Street to 44th Street , by the construction of an Eight inch sewer, together with the necessary appurtenances, and doing all other work in connection tnerewith to make a complete improvement , in accordance with a petition signed by one hundred percent (100 ) of the owners of the lineal frontage and one hundred percent (100L ) of the area within the district petitioning for said improvement; creating a local improve- ment district ; creating a local improvement district fund therefor ; providing for the payment of said improvement to be made by special assessment on the property in said district under the rode of pay- ment by bonds . r'HERE S , there has been heretofore filed with the City Council of the City of Lverett a petition signed by one hundred percent (100%) of the owners of the lineal frontage and one hundred percent (100 - ) of the area within the district, petitioning for the improvement of the alley East of Terrace Drive , from 43rd Street to 44th Street , by the construction of en Light inch sewer, together with the necessary appurtenances , and doing all other work in connection therewith to make a complete improvement ; and 1I HEREAS, the cost of the improvement may exceed the assess- ed value of the property, less improvements and less outstanding unpaid local improvement assessments ; and WHEREAS, the City Council has by unanimous vote held the improvement to oe necessary for the public health and benefit and has ordered the sane . NOW, TEEREFOR.E, TEE CITY OF EVERETT DOES ORDAIN: Section 1 : That the vity Liouncil of Everett, by unanimous vote , finds the improvement herein described to be necessary for the public health and benefit and so orders the improvement . Section 2 : That the alley East of Terrace Drive , from 43rd Street to 44th Street , be improved by the construction of an Light inch sewer, together with the necessary appurtenances end doing all other work necessary in connection therewith to make a complete improvement , all in accordance with the plans and specifica- tions prepared under the direction of the Engineer of the City of Everett, which plans and specificat__ons are hereby approved and adopted. Section 3: That the cost and expense of such improve- ment , including all necessary incidental expense , shall be borne by and assessed against the property incluaed in the assessment dis- trict herein created in accordance with law. he City yhof costs shall not be liable in any manner for any portionChaptercs and expenses of such improvement , except as provided by 141, Session Laws of 1923, or acts amendatory thereto, and the ordinances of the City of Everett.
