ORDINANCE Igo. 3069. AN ORDINII-CE providing for the improvement of PcDougall Avenue from l:_th Street to the I-orth line of Hilton' s Second Addition to _�verett by grading to proper rade, installation of a 4: Six inch water main, fire hydrants and necessary appurtenances, construction of concrete curbs and gutters, installation of necess-` ary drainage, and doing all other wor1 necessary to make a complete improvement; in accordance with a majority petition therefor ; creat- ing an assessment district; creating a local improvement district fund therefor, and providing for the payment of said improvement by' special assessment on the property in said district under the mode of payment by bonds. WHEREAS, there has been heretofore filed with the City Council of the City of Everett a majority petition of the property owners petitioning for said improvement , and upon examination thereof the said City Council has found the things set forth therein to be true ; and /TI REAjS, TEE St TD P1!TITIOT'T NHS B.EEY REFERRED TO TITI±; Commissioner of Public ',:orks to be examined by said Commissioner and the City 'Engineer, and the Commissioner of Public Yorks has filed with the City Council all data and information required by law; and 'TI RELS, said Commissioner of Public Yorks has recommended to the City Council that said improvement petitioned for be made , and it appearing to the City Council that the public health,con- venience and necessity require that such improvement be made . HOW, TFEREFORE, the CITY OF EVERETT DOES ORDAIN: Section 1: "_'hat McDougall !-:venue from 15th Street to the North line of L-_ilton's Second ± ddition to Everett be im- proved by grading to proper grade, installation of a Six inch water main, fire hydrants and necessary appurtenances, construction of concrete curbs and gutters, installation of necessary drainage and doing all other work necessary to make a complete improvement all according to the plans and specifications prepared under the direction of the city Engineer, and which plans and specifications are hereby adopted and approved. Sections: That the cost and expense of such improvement, including all necessary incidental expense , shall be borne by and assessed against the property included in the assessment district herein created in accordance with law. The City of Everett shall not be liable in any manner for any portion of the costs and expenses of such improvement except as provided by Chapter 141 Session Laws of 1923, or acts amendatory thereto and the ordinances of the City of Everett . Section 3: That there is hereby established a local mproverrent district to be known as ",-ocel Improvement District ?o . 567 _" , which district shall include the following described. property located in Everett, Snohomise County, Washington, to-wit: Lots 7 to 16 inclusive , clock 286 , Hiltons Second Addition to Everett; Lots 17 to 26 inclusive , block 287 , Hilton' s Second Addition to Everett .
