3 0 ORDINANCE No . 3062 . AN OPDINANCE providing; for the improvement of the alley between Broadway and McDougall 1,venue from 26th Street to 25th ! Street , cy grading to Proper grade , construction of a Portland cement concrete pavement sixteen feet in width, installation of necessary drainage , and doing all other work necessary to make a complete improvement in accordance with a majority petition therefor; creating an assessment district ; creating a local improvement district fund therefor, providing for the payment of said improvement by special assessment on the property in said district under the mode of "Immediate Payment ." ;:AREAS, there has been heretofore filed with the City , Council of the City of Everett a majority petition of the property ovine petitioning for said improvement , and upon examination thereof the said city Council has fount_ the things set forth therein to be true; and d EREAL, the said petition has been referred to the Commissioner of Public ': orks to be examined oy said Commissioner and the City Engineer, and the Commissioner of Public 'r'orks has filed with the City Council all data and information required by law; and WHEREY,S, said Commissioner of Public Works has recommended to the City Council that said improvement petitioned for be made , and it appearing to the Cit- Council that the public health, con- venience and necessity require that such improvement be made . Mans and specifications pre- pared unaer the direction of the City -angineer, which plans and specifications are hereby adopted and approved. Section 2: That the cost and expense of such im- provement , including all necessary incidental expense , shall be borne by and assessed against the property included in the assess-' went district herein created in accordance with law. The City of Everett shall not be liable in any manner for any portion of the costs and expenses of such improvement except as provided by Chapter 141 , Session Laws of 1923, or acts amendatory thereto and the ordinances of the City of Everett .
