I <br /> ORDINANCE NO. 2266-98 <br /> AN ORDINANCE concerning the Municipal Arts Fund, amending Section 3A(2) of <br /> Ordinance No. 1471-88 (EMC 2.95.030A(2)). <br /> WHEREAS, in calculating the total project cost for appropriations from the municipal <br /> arts fund, certain sources of funds are deducted including federal revenue sharing and <br /> grants; and <br /> WHEREAS, during the planning process for the Everett Multi-Modal Transportation <br /> Center, the City has received comments related to the importance of designing attractive <br /> facilities; and <br /> WHEREAS, the Federal Transit Administration(FTA) encourages transit agencies to <br /> pursue the incorporation of public art in their systems to improve customer comfort and <br /> safety, and reinforce the spirit and identity of cities and towns; and <br /> WHEREAS, Circular 9400.1 A of the FTA dated June 9, 1995 states in part that"good <br /> design and art can improve the appearance and safety of a facility, give vibrancy to its <br /> public spaces, and make patrons feel welcome. Good design and art will contribute to the <br /> goal that transit facilities help to create livable communities;" and <br /> WHEREAS, Circular 9400.1A "...reaffirms that costs for design and art are eligible costs <br /> for FTA-funded transit projects..."and that "FTA will fund the costs of design, <br /> fabrication, and installation of art that is part of a transit facility;" and <br /> WHEREAS, Circular 9400.1A states that"funds spent on the art component of projects <br /> should be appropriate to the overall costs of the transit project and adequate to have an <br /> impact. These costs should be all-inclusive and generally should be at minimum one-half <br /> of 1 percent of construction costs, but should not exceed 5 percent of construction costs, <br /> depending on the scale of the project;" and <br /> WHEREAS, the City's municipal arts fund ordinance should be amended to provide the <br /> City Council the discretion on a project by project basis to include additional sources of <br /> funding in the calculation of total project cost for transit related projects; and <br /> WHEREAS, the Multi-Modal Transportation Center Project will proceed into <br /> Preliminary Engineering in early 1998 and the FTA encourages that"artists should be <br /> involved in the initial stages of project development;" <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> SECTION 1: Section 3A(2) of Ordinance No. 1471-88 (EMC 2.95.030A(2)), which <br /> currently reads as follows: <br /> 1 <br />
