LN OrDIPT: ''.CE providing for the improvement of Federal Avenue from 40th Street to 41st Street , by the construction of an EiFht Inch sewer End its necessary appurtenances, and doing all uork necessary to make a complete improvement , in accordance with a petition signed by the owners of more than Sixty percent of the lineal frontage end by the owners of more then Seventy- five percent of the area within the proposed district petition- ing for said improvement ; creating a local improvement district ; creating a local improvement district fund therefor, and provid- ing for the iayment of said improvement by special assessment on the property in said district under the mode of payment by bonds. 7EEREL there has been heretofore filed with the City Council of the City of Everett a petition signed by the owners of more than Sixty percent of the lineal frontage and by the owners of more than Seventy-five percent of the area within the proposed district, petitioning for said improvement, and upon exarc_ination thereof the City Council has found the things set forth therein to be true ; end WHEREAS, the said petition has been referred to the Commissioner of Public forks to be examined by the said Commis- sioner and the City Engineer, and the Commissioner of Public 'forks has filed with the City Council all data and information required by law; and ':`: 'REA.S, said Commissioner of Public `Works has recomruended to the City Council try t the said improvement petitioned for be made , and it appearing to the City Council that the public health, convenience and necessity require that such improvement be made. NO I, TT-TEREFOPE , TT J CITY OF EV. PETT DOES ORDAIN: Section 1: That Federal ,venue from 40th Street to 41st Street be improved by the construction of an Light inch sewer and its necessary appurtenances, and doing all work necessary to make a complete improvement , all according to the plans and specificationsprepar•ed under the direction of the City Engineer, such plans and specifications are hereby adopted and approved. Section 2 : That the cost and expense of such improve- ment , including Ell necessary incidental expense, shall be borne by and assessed against the property included in the assessment district herein created in accordance with law. The City of Everett shall not be liable in any manner for any portion of the costs end expenses of such improvement, except es provided by Chapter 141 Session LE-ws of 1923, or actsainendetory thereto, and the ordinances of the City of Everett. Section 3: That there is hereby established a local improvement district to be known as "Local Improvement District No. 564 " which district shall include the following des- cribed property:
