AN ORDINANCE providing for the improvement of the alley in Block 623, Plat of Everett, between Rucker Avenue and "Hoyt Avenue from Everett Avenue to California Street , by grading to proper grade , installation of necessary drainage End paving the full width of said alley with Portland cement concrete, and doing all work necessary to make a complete improvement in accordance with a majority petition therefor ; creating an assessment district ; creating a local improvement district fund therefor, providing for the payment of said improvement by special assessment on the property in said district under the mode of payment by bonds. WHEREAS, there has been heretofore filed with the City Council of the City of Everett a majority petition of the property owners petitioning for said improvement , End upon examination thereof the said City Council has found the things set forth therein to be true ; and WHEREAS, the said petition has been referred to the Commissioner of Public Works to be examined by said Commissioner and the City Engineer, and the Commissioner of Public Works has filed with the City Council all data end information required by law; End WHEREAS, said Commissioner of Public Works has recommended to the City Council that said improvement petitioned for be made, and it appearing to the City Council that the public health, convenience and necessity require that such improvement be made . NOW, THEREFORE, THE CITY OF EVETETT DOES ORDAIN: Section 1: That the alley in Block 623, Plat of Everett , between Rucker ve ue an Hg t Avenue from Everett Avenue to California Street tyl*ARY to proper grade, installa- tion of necessary drainage and paving the full width of said alley with Portland cement concrete, and doing all work necessary to make a complete improvement all according to the plans end specifications prepared under the direction of the City Engineer, which plans and specifications are hereby adopted and approved. Section 2: That the cost and expense of such improve- ment, including all necessary incidental expense, shall be borne by and assessed against the property included in the assessment district herein created in accordance with law. The City of Everett shall not be liable in any manner for any portion of the costs and expenses of such improvement , except es provided by Chapter 141, cession Laws of 1923, or acts amendatory thereto end the ordinances of the City of Everett . Section 3: That there is hereby established a local improvement district to be known as "Local Improvement District No. 561 ," which district shall induce the following described property located in Everett, Snohomish County , Washington, to-wit:
