� 4 1 r . ORDINANCE No. q 7 AN ORDINANCE authorizing the connection of a sanitary sewer serving Twenty (20 ) housing units located South of the City Limits of the City of veret t and owned by h. F. Johnson end Emily Johnson, his wife, with the City sewer at the South end of said City; fixing the terms end conditions thereof; fixing the charges therefor, and declaring an emergency. TH, CITY OF : VERETT DOES ORDAIN: Section 1: That W. F. Johnson and Emily Johnson, hi- wife , being the owners of Lots ' hree (3) , Four (4) , Thirty-one (31) , Thirty-two (32) and Thirty-four (34) , Block Three (3) , Beverly Hills Addition No. 4, in Snohomish County, ashington, on which there have been constructed or are being constructed Twenty (20 ) housing units, be, and they are hereby granted per- mission to connect a sanitary sewer constructed for the purpose of serving said Twenty (20) housing units only on the above describe• real estate with a sewer of the City of Everett , said connection to be made at a manhole on the -girth line of Federal housing Pro- ject located six hundred sixty (660) feet North of the South Cite Limits of Everett, upon the terms and conditions herein set forth Section 2 : That 4e. F. Johnson and Emily Johnson, hi- wife, shall agree to assume all necessary expenses for City inspection and cost of constructing sewer and appurtenances withi' the City Limits of the City of ,verett, said work to be done under the supervision of the City Engineer of :Everett. Section 3 : That W. F. Johnson and Emily Johnson, his wife , shall assume and pay the expenses of maintenance of said sanitary sewer and shall hold the City of Everett harmless for any claims or damages of whatsoever nature that would be caused by constructing said sewer and necessary maintenance . Section 4: Said sewer shall be used for sanitary purposes only end no creek water shall be turned into said sewer, and no storm water shall be turned into said sewer unless authorized by the City Engineer. Section 5: That said W. F. Johnson end Emily Johnsob , his wife, shall furnish to the City of Everett a surety bond in the sum of One Thousand Dollars (Z)1,000 .00) conditioned that they or their assigns or successors shall comply with the terms of thi . ordinance and any agreement entered into pursuant thereto. Section 6: The City Council of the City of Everett is hereby authorized and directed to enter into an agreement with the said W. F. Johnson and Emily Johnson, his wife , for the connection of said sewer according to the terms end conditions hereof, end said City Council is authorized to 'nuke such addition al terms and agreements with reference to said sewer as it shall determine.
