ORDINANCE No. <br /> �- � .37 <br /> AN ORDIN JTCE providing for the improvement of Colby <br /> Avenue from 24th Street to 26th Street ny installation of a <br /> street lighting system, and doing all work necessary to make a <br /> complete improvement , in accordance with a majority petition <br /> therefor, creating an assessment district, creating a local <br /> improvement district, creating a local improvement district <br /> fund therefor , providing for payment of said improvement by <br /> special assessments on the property in said district under the <br /> mode of payment by bonds. <br /> WEREAS, there has heretofore been filed with the City Council <br /> of the City of Everett a majority petition of the property <br /> owners on Colby Avenue from 24th Street to 26th Street, petition- <br /> ing for the installation of an electric street lighting system; <br /> and <br /> WHLMEAS, after due hearing on said petition it appears <br /> to the City Council that Public convenience and necessity require <br /> that said improvement be made . <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: That Colby Avenue from 24th Street to <br /> 26th Street be improved by the installation of an electric <br /> street lighting system, said system to include trenching, laying <br /> of cable , replacement of existing walks and driveways after <br /> trenching, laying conduit , installing posts and right units, <br /> and Ell other materials, and doing all other work necessary to <br /> make a complete improvene nt, all according <br /> ntof the <br /> heplans <br /> and <br /> specifications prepared under <br /> ity <br /> Engineer, which plans and specifications are hereby adopted <br /> and approved. <br /> Section 2: That the cost and expense of such <br /> improvement , including all necessary incidental expenses, <br /> shall be borne by and assessed against the property included <br /> in the assessment district herein created in accordance with <br /> law. The City of Everett shall not be liable in any manner <br /> for any portion of the costs and expenses of such improvement <br /> 1, <br /> xcapt es provided by endatory thereto,er and4ordinances oft1thes f City ofor <br /> acts r1 Y <br /> Everett. <br /> Section 3 : There is hereby established a local <br /> improvement district to be known as local improvement <br /> d.e district <br /> No. 557 , which district shall include the following <br /> bed <br /> property, to-wit: <br /> Lot 1, Block 552, Plet of Everett <br /> Lot 32, Block 553, Plat of Everett <br /> West Half of Block 552, Monitor Addition to Everett; <br /> East Half of Block 553, Monitor Addition to Everett ; <br /> Lots 25 to 32 inclusive, Block 561, Monitor Addition <br /> to Everett ; <br /> Lots 17 to 24 inclusive, Block 561, Rucker' s First <br /> Addition to Everett; <br /> Lots 1 to 8 inclusive, Block 562, Monitor Addition <br /> to Everett; <br /> Lots 9 to 16 inclusive, Block 562, Rucker' s First <br /> Addition to Everett. <br />
