ORDIP1l--:R CE No.G 47 AN ORDINANCE providing for the improvement of Hoyt Avenue from 45th Street to 49th Street ; also 47th Street from Hoyt Avenue to Central Avenue , by installation of Six Inch Water mains and lire Hydrants and doing all work necessary to make a complete improvement; creating an assessment district ; creating a local improvement district fund therefor; providing that the payment of said improvement be made by special assessment on the property in said district under the mode of payment by bonds for materials used, fixed estimate and all other expenses, except cost of labor furnished by federal funds under WPA plan of the Federal Government . WHEREAS, a majority petition of the property owners petitioning for said improvement has heretofore been filed with the City Council and upon examination thereof the said City Council has found the things set forth therein to be true; and WHEREAS, the said petition has been referred to the Commissioner of -cublic Works to be examined by the said Commission- er and the City Engineer and the Commissioner of 2ublic Works has filed with the City Council all data and information as required by law; and WHEREAS, said Commissioner of Public Works has recommend- ed to the City Council that said improvement petitioned for be made , and it appearing to the City Council that the public health convenience and necessity require that such improvement be made. NOW, THEREFORE, the City of Everett DOES ORDAIN: Section 1: That Hoyt Avenue from 45th Street to 47th Street; also 47th Street from Hoyt Avenue to Central Avenue be improved by installation of Six Inch Water Mains and Fire Hydrants and doing all work necessary to make a complete improve- ment, all according to the plans and specifications prepared under the direction of the City Engineer, which plans and specifications are hereby adopted and approved. Section 2: That the cost and expense of all materials required to make a complete improvement, the fixed estimate and all other expenses of every kind, except cost of labor contributed by the Federal Government under WPA , shall be borne by and assessed against the property included in the assessment district herein created in accordance with law. The City of Everett shall not be liable in any manner for the cost and expense of such improvement , except as provided in Chapter 141, Session Laws of 1923, or acts amendatory thereto, and the ordinances of the City of Everett . Section 3: There is hereby established a local improvement district to be called Local Improvement District No. S , which district shall include the following des- cribed pro3erty, located in Everett , Snohomish County, Washington, to-wit:
