uRDINANCE No. <br /> AN ORDINANCE providing for the improvement of 16th <br /> Street from Walnut to Chestnut by construction of concrete curbs, <br /> gutters and sidewalks, installation of necessary drainage, <br /> graveling, and doing all work necessary to make a complete <br /> improvement; creating an assessment district; creating a local <br /> improvement district fund therefor; providing that the payment of <br /> said improvement be made by special assessment on the property in <br /> said district under the mode of Payment by bonds for materials <br /> used, fixed estimate and all other expenses, , except cost of labor <br /> furnished by federal funds under TPA plan of the Federal Governme t. <br /> IEREAS, a majority petition of the property owners <br /> petitioning for said improvement has heretofore been filed with <br /> the City Council and upon examination thereof the said City <br /> Council has found the things set forth therein to be true ; and <br /> WHEREAS, the said petition has been referred to the <br /> Commissioner of Public Works to be examined by the said Conmissio•- <br /> er and the Cityngineer and the Commissioner of Public Works <br /> has filed with the City Council all data and information as <br /> required by law; and <br /> W EREAS, said Commissioner of rublic forks hasreconm.ended to the <br /> City Council that said improvement petitioned for be made, and <br /> it appearing to the City Council that the public health, con- <br /> venience and necessity require that such improvement be made. <br /> NOW, THEREFORE, the City of Everett DOES ORDAIN: <br /> Section 1: That 16th Street from Walnut to Chestnut <br /> be improved by construction of concrete curbs, gutters and side- <br /> walks, installation of necessary drainage, graveling, and doing <br /> all work necessary to make a complete improvement, all according <br /> to the plans and specifications prepared under the direction of <br /> the City Engineer, which plans and specifications are hereby <br /> adopted and approved. <br /> Section 2 : That the cost and expense of all materials <br /> required to make a complete improvement , the fixed estimate and <br /> all other expenses of every kind, except cost of labor contributed <br /> by the Federal Government under \JPA, shall be borne by and assessed <br /> against the property included in the assessment district herein <br /> created in accordance with law. The City of Everett shall not be <br /> liable in any manner for the cost and expense of such improvement, <br /> except as provided in Chapter 141, Session Laws of 1923, or acts <br /> amendatory thereto,and the ordinaces of the City of Everett. <br /> Section 3: There is hereby established a local <br /> improvement district to be called Local Improvemant District <br /> No. S J Sf , which district shall include the following des- <br /> cribed property, located in Everett, Snohomish County, Washington, <br /> to-wit: <br />
