ell1P/%/"Iim' <br /> 40111111Vmji4iigif <br /> ORDINANCE NO. 2291-98 <br /> AN ORDINANCE relating to penalties for violating the provisions of no contact orders <br /> and orders for protection, amending section 1 of Ordinance 1234-86, as amended by <br /> section 1 of Ordinance 1807-91 (EMC 10.22.010), section 2 of Ordinance 1234-86, as <br /> amended by section 2 of Ordinance 1807-91 (EMC 10.22.020), and section 4 of <br /> Ordinance 1234-86, as amended by section 3 of Ordinance 1807-91 (EMC 10.22.040) <br /> WHEREAS, the Washington State Legislature has increased the penalties for violating the <br /> provisions of no-contact orders and orders for protection in domestic violence cases; and <br /> WHEREAS, the City of Everett City Council deems it appropriate for the Everett Municipal <br /> Code provisions relating to no-contact orders and orders for protection to be consistent with state <br /> law. <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: Section 1 of Ordinance 1234-86, as amended by section 1 of Ordinance 1807-91 <br /> (EMC 10.22.010), which reads as follows: <br /> Violation of no-contact order-Pre-trial. <br /> Wilful violation of a court order issued under RCW 10.99.040(2) or RCW 10.99.040(3) is a <br /> misdemeanor. Any assault that is a violation of an order issued under RCW 10.99.040 and <br /> that does not amount to assault in the first or second degree under RCW 9A.36.011 or <br /> 9A.36.021 is a class C felony, and any conduct in violation of a protective order issued <br /> under RCW 10.99.040 that is reckless and creates a substantial risk of death or serious <br /> physical injury to another person is a class C felony. The written order releasing the person <br /> charged or arrested shall contain the court's directives and shall bear the legend: <br /> "Violation of this order is a criminal offense under chapter 10.99 RCW and will subject a <br /> violator to arrest: any assault or reckless endangerment that is a violation of this order is a <br /> felony." <br /> If a no-contact order has been issued prior to charging, that order shall expire at <br /> arraignment or within seventy-two hours if charges are not filed. <br /> is hereby amended to read as follows: <br />
