ORDINANCE 14o. f7] 6 !CT ORDINANCE providing for the improvement of Friday Avenue , Forty (40) feet South of 40th Street to 41st Street, and also 41st Street from Friday Avenue to manhole at Grand Avenue , by the construction of a sewer and its necessary appurtenances, and doing all other work in the entire district necessary to make a complete improvement; creating an assess- ment district; creating a local improvement district fund therefor; eproviding that the payment for said improvent be made by special assessment on the property in said district under the mode of payment by bonds for materials used , fixed estimate and all other expenses , except cost of labor furnished by Federal funds under WPA plan of the Federal Govern- ment. WHEREAS, a majority petition of the property owners petitioning for said improvement has heretofore been filed with the City Council, and upon examination thereof the said City Council has -found the things set forth therein to be true; and WHEREAS, the said petition has been referred to the Commissioner of Public Works to be examined by the said Conhmissiozgrond the Engineer, and the Commissioner of -J?ualic Works has filed with the City Council all data and information - as required by law; AID WHEREAS, said Commissioner of Public Works has recommended to the City Council that said improvement petitioned for be made, and it appearing to the City Council that the public health, convenience and necessity require such improvement be made; and WHEREAS, it further appears that such improvement should be made only in the event that federal funds may be secured from the WPA for the payment of labor costs, and the property owners of the district be assessed a sum for the cost of all materials, fixed estimate and all other expenses of every kind not provided for by the Federal Government under WPA and that such improvement should only be commenced upon the assurance that the Federal Government under 'NPA will furnish certain labor costs in connection with said improvement. iOW, THEREFORE, THE CITY OF EVERETT DOES OR.D.AIN: Section 1: That Friday Avenue Forty (40) feet South of 40th Street to 41st Street , and also 41st Street from Friday :.venue to the manhole at Grand Avenue be improved by the construction of a sewer and its necessary appurtenances, and doing all other work in the entire district to make a complete improvement according to the plans and specifications prepared under the direction of the City Engineer, which plans and specifications are hereby adopted and approved. Section 2: That the cost and expense of all materials required to make a complete improvement , the fixed estimate and all other expenses of every kind , except cost of labor contributed by the Federal Government under WPA shall be borne by, and assessed against the property included in the assessment district herein created, in accordance with law. • The City of _:_verett shall not be liable in any manner for any
