4111 • 41 • ORDINANCE NO. 2274 An Ordinance providing for the improvement of Broadway Ave., from the end of the present sewer to llth Street, by the construc- tion of a sewer and its necessary appurtenances, and doing all other work necessary to make a complete improvement, creating an assessment district, creating a Local ILprovement District Fund therefor, and providing that payment for said improvement be made by special assessment on the property in said District un- der the mode of payment by bonds. WHEREAS, a majority petition of the property owners, peti- tioning for said improvement, has heretofore been filed with the Commissioner of Public Works and said Commissioner has found the things set forth in said petition to be true; and WHEREAS, said Commissioner of Public Works has filed with the City Council all data and information, as required by law; and WHEREAS, said Commissioner if Public 7orks has recommend- ed to the City Oouncil that said improvement petitioned for be ride, and it appearing to the City Council that public conven- ience and necessity requires such improvement to be made; now, therefore, THE CITY OF EVERETT DOES ORDALI: Section 1: That Broadway Avenue, from the end of the present sewer to llth Street, be improved by the construction of a sewer and its necessary appurtenances, and doing all other work neces- sary to make a complete improvement, according to the plans and specifications, prepared under the direction of the City Engineer, which plans and specifications are hereby adopted and approved. Section 2: That the cost and ex-enses of such improvement including all necessary incidental expenses, shall be borne by and assessed against the property included in the assessment dis- trict herein created in accordance with law.
