/SIP <br /> ORDINANCE NO. 2364-99 <br /> AN ORDINANCE providing for the adoption of the Everett Electrical <br /> Code and repealing Ordinance No. 2073-95 (Chapter 16.05 EMC) <br /> WHEREAS, the City Council finds that this ordinance serves to protect the public health, <br /> safety and welfare; and <br /> WHEREAS,the City Council finds that the absence of the regulations adopted by this <br /> ordinance would create a public harm and a public nuisance; and <br /> WHEREAS,the City Council finds that the City is mandated by the State to implement and <br /> enforce the herein adopted code; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: This ordinance shall be known as the "Everett Electrical Code." <br /> Section 2: The National Electrical Code, 1996 Edition, published by the National Fire <br /> Protection Association, the Department of Labor and Industries Rules and Regulations for installing <br /> electrical wires and equipment and Administrative Rules (Chapter 19.28 RCW), and the Department <br /> of Labor and Industries Electrical Installation Law (Chapters 296-46 and 296-401 Washington <br /> Administrative Code) as adopted by the State of Washington September, 1997, are. hereby adopted <br /> by reference except as such portions as are hereinafter deleted, amended or specified and <br /> incorporated herein as fully as if set out at length herein, collectively herein referred to as the <br /> "Code" unless specifically provided otherwise. <br /> Section 3: Amendments Made in the National Electrical Code. <br /> A. The National Electrical Code is amended by adding on Article 80 - Administrative <br /> section which shall read as follows: <br /> 80-1 EXISTING BUILDINGS. Buildings or structures to which additions, alterations or <br /> repairs are made to electrical system, including any and all electrical wires, services, <br /> equipment and apparatus shall comply with all the requirements for new work in buildings <br /> and structures as set forth in this Code except as specifically provided for in this section. <br /> (a) In the event of unsafe or hazardous wiring, Section 11 shall take precedence. <br /> 80-2 MAINTENANCE. All electrical wires, equipment and apparatus shall be maintained <br /> in a safe condition. All devices and safeguards which are required by this Code in a <br /> building, sign or structure when erected, altered or repaired shall be maintained in a safe and <br /> good working order. The owner or his agent shall be responsible for the maintenance of all <br /> such electrical wiring, equipment and apparatus. <br /> 1 <br />
