ORDINANCE NO. 2204 • <br /> An ordinance relating to the issuance of permits to open <br /> sidewalks or paving on the streets or alleys of the City of <br /> Everett, prescribing the terms and conditions under which the sane <br /> may be done, and declaring an emergency. <br /> THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: It shall be unlawful for any person other than a <br /> duly authorized officer, agent or employee of the City of Everett, <br /> to make any opening in any sidewalk or pavement on any of the alleys <br /> or public streets of the City of Everett without having first obtained <br /> a permit from the Commissioner of Public Works so to do. Before any <br /> permit will be issued for any of the above named purposes, a deposit <br /> shall be made with the City Treasurer in the sum of 425.00 for each <br /> opening of one square yard or less, and an additional deposit of <br /> 10.00 for each and every additional square yard or fractional part <br /> thereof. If openings are maintained and repaired by the City, the <br /> entire deposit shall be forfeited to the City. The repair of any <br /> sidewalk or pavement, and the back filling of all tunnels under permit <br /> from the City so to do, shall be made under the supervision, and <br /> subject to the approval of the Commissioner of Public Works. Repair <br /> of pavement shall extend six inches below, and six inches under the <br /> pavement around all openings. Repairs of sidewalk shall extend two <br /> inches below and three inches under the sidewalk around all openings. <br /> All repairs made under the provisionsof #ate- Ordinance shall be <br /> completed within thirty days, or the deposit made for permit will <br /> be forfeited. Tunnels made under the provisions of this Ordinance <br /> shall be back filled and inspected by a duly authorized officer, agent <br /> or employee of the City before the pavement or sidewalk above same <br /> is replaced. <br /> Section 2. Any person, firm or corporation violating any of <br /> the provisions of this ordinance shall, upon conviction, be fined <br /> in a sum not to exceed 4300.00, or punished by imprisonment not to <br />
