• • ORDINANCE NO. 2373-99 `' J An Ordinance Rezoning Two Properties Located to the West Side of Holly Drive, To Correct Errors in the Assignment of Zoning to Mukilteo School District Property, as Part of the Annual Update to the Comprehensive Plan Initiated in 1998. WHEREAS, the City of Everett adopted a new Comprehensive Plan in August, 1994, in conformance with the Washington State Growth Management Act; and WHEREAS, the Growth Management Act, codified as RCW Chapter 36.70A, generally allows for comprehensive plans to be amended on an annual basis; and WHEREAS, the City of Everett initiated its third annual comprehensive plan amendment process in July, 1998, which included consideration of Land Use Map amendment and rezone applications; and WHEREAS, the City initiated amendments to the Comprehensive Plan Land Use Map and Zoning Map to correct errors that had occurred related to designations of school district properties; and WHEREAS, errors had occurred in relation to the zoning of the Mukilteo School District ACES High School property; and WHEREAS, the City Council held a Public Workshop on January 27, 1999, and a Public Hearing on February 3, 1999, to consider the recommendations of the Planning Commission concerning various amendments to the Land Use Map and the rezoning of specific properties as part of the 1998 Comprehensive Plan update process; and WHEREAS, the City Council has adopted Ordinance No. 2372-99 amending the land use designation of the Everett Comprehensive Plan for the subject properties in support of the requested rezone; and WHEREAS, the City Council finds: 1. The proposed rezone actions implement the revised land use designation of the City's Growth Management Comprehensive Plan; 2. By implementing the Comprehensive Plan land use designation, the proposed rezone action bears a substantial relation to the public health, safety and welfare; and
