ORDINANCE NO. 3028-07 - <br /> An Ordinance relating to the impoundment of vehicles by police officers . s l arking <br /> enforcement officers, amending Section 1 of Ordinance No. 993-83, as amended by <br /> Section 1 of Ordinance No. 1068-84, Ordinance No. 1531-88 and Ordinance No. 2396-99 <br /> (EMC 46.10.010). <br /> Whereas,the Everett City Council has been advised 2007 State Legislature expanded the <br /> authority for police officer vehicle impoundment to include circumstances where the <br /> person was operating a motor vehicle without the special endorsement required for the <br /> type of motor vehicle operated; and <br /> Whereas, the Everett City Council has been advised 2007 State Legislature also <br /> expanded the authority for police officer vehicle impoundment to include circumstances <br /> where a vehicle with an expired registration of more than forty-five days has been parked <br /> on a public street; and <br /> Whereas,the Everett City Council has been advised that the State also provides authority <br /> for police officer vehicle impoundment where a vehicle is parked in a properly-signed <br /> commercial loading zone, restricted parking zone, or other similar zone; and <br /> Whereas, State law amendments became effective July 22, 2007; and <br /> Whereas, the Everett City Council deems it appropriate for the City Traffic Code to be <br /> consistent with state law in this area; <br /> NOW, THEREFORE,THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: Section 1 of Ordinance No. 993-83, as amended by Section 1 of Ordinance <br /> No. 1068-84, Ordinance No. 1531-88 and Ordinance No. 2396-99 (EMC 46.10.010), <br /> which reads as follows: <br /> Officers authorized to remove certain vehicles. <br /> A. Impoundments. Whenever the driver of a vehicle is arrested for a violation of <br /> RCW 46.61.502 or 46.61.504, the vehicle is subject to impoundment at the direction of a <br /> law enforcement officer. In addition, a police officer or parking enforcement officer may <br /> take custody of a vehicle and provide for its prompt removal to a place of safety under <br /> any of the following circumstances: <br /> 1. Whenever any police officer or parking enforcement officer finds a vehicle <br /> stopped or parked upon any roadway or alley, whether attended or unattended, the officer <br /> is authorized to provide for the removal of the vehicle or require the driver or other <br />
