• <br /> ORDINANCE NO. 2424-99 <br /> AN ORDINANCE to implement the Comprehensive Plan by establishing transportati• pact <br /> fees for new projects that are categorically exempt under the State Environmental Policy Act and <br /> are therefore not covered by the City's Transportation Mitigation Ordinance. <br /> WHEREAS, the City Council finds that growth and development should pay a proportionate <br /> share of the cost of the transportation network needed to serve it; and <br /> WHEREAS, the City has analyzed the impact of new development on the transportation system <br /> through its comprehensive planning and subarea planning processes including plan-level SEPA <br /> review and has determined requirements for traffic studies, mitigation, and impact fees that are <br /> reasonably related to new development and are based on studies and experience with the actual <br /> impact of projects; and <br /> WHEREAS, the impact fee schedule has been reasonably adjusted for taxes and other revenues <br /> that are anticipated to be available to fund public improvements under the City's capital facilities <br /> plan and will not fully recover the proportionate share attributable to new projects; and <br /> WHEREAS, Ordinance No. 2425-99, the City's Transportation Mitigation Ordinance (TMO), <br /> does not govern proposed projects that are categorically exempt under the State Environmental <br /> Policy Act, although such projects may generate new traffic and cause adverse impacts on the <br /> transportation system that require transportation system improvements; and <br /> WHEREAS, the City Council finds that this ordinance will implement and promote the <br /> Comprehensive Plan, is consistent with state law requirements for transportation impact fees <br /> contained in RCW 82.02.050 et seq., and will protect the public health, safety and welfare; <br /> NOW,THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: Title, authority, and purpose <br /> 1.1. Title. The ordinance codified in this chapter may be referred to or cited as the Small <br /> Project Impact Fee Ordinance, or"SPIFO," and will be referred to herein as"this chapter." <br /> 1.2. Purpose and authorization. The purpose of this chapter is to implement the City's <br /> Comprehensive Plan including its Transportation and Capital Facility Elements. This chapter <br /> enables the City to collect impact fees from proposed projects that generate additional traffic and <br /> are categorically exempt under the State Environmental Policy Act (SEPA) and the state rules <br /> adopted thereunder (WAC 197-11-305) and therefore not subject to Ordinance No. 2425-99, the <br /> City's Transportation Mitigation Ordinance (TMO). The fees adopted under this chapter are <br /> authorized by and in accordance with the provisions of RCW 82.02.050-.090. <br /> -1- <br />
