4'y <br /> doiv....4 <br /> tv,"" <br /> ' Atos/ <br /> ORDINANCE NO. 2442-00 <br /> AN ORDINANCE amending the City's Park Code; amending Sections 4, 6, 7, 8, 9, <br /> 11, 13, 14, 16, 17, 20, 22, and 23 of Ordinance No. 3471 (EMC Sections 9.06.020, <br /> 9.06.050, 9.06.060, 9.06.070, 9.06.080, 9.06.100, 9.06.120, 9.06.130, 9.06.150, 9.06.160, <br /> 9.06.190, 9.06.210 and 9.06.220), Section 5 of Ordinance No. 3471, as amended by <br /> Section 1 of Ordinance No. 1035-84 (EMC 9.06.040), Section 1 of Ordinance No. <br /> 1615-89 (EMC 9.06.034), and Section 25 of Ordinance No. 3471, as amended by <br /> Section 2 (part) of Ordinance No. 293-74 (EMC 9.06.240); and repealing Section 18 of <br /> Ordinance No. 3471,Automobile Testing, (EMC 9.06.170). <br /> WHEREAS, the City's Park Code has not had any significant updates for over twenty years; and <br /> WHEREAS, the City of Everett City Council deems it appropriate to bring the Park Code up to <br /> date, and to address improper conduct and behavior in the parks. <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: Ordinance No. 3471, as amended, (Chapter 9.06 EMC) is hereby amended by the <br /> addition of the following new section: <br /> Alcoholic Beverages. <br /> It is unlawful for any person to consume or possess any alcoholic beverage in a city park, <br /> including unopened alcoholic beverage containers; Provided, this prohibition shall not apply to <br /> organized groups which have secured a permit from the Parks Director or his or her designee <br /> and, if required, from the Washington State Liquor Control Board. Violation of any of the <br /> provisions of this section is a misdemeanor, and may be punished by a fine of not more than one <br /> thousand dollars ($1,000.00) or by imprisonment not to exceed ninety (90) days or by both such <br /> fine and imprisonment. <br /> Section 2: Ordinance No. 3471, as amended, (Chapter 9.06 EMC) is hereby amended by the <br /> addition of the following new section: <br /> Possessing or Obtaining Tobacco by Minor—Refusal to Give Information. <br />
