ORDINANCE NO. 2461-00 AN ORDINANCE providing for the vacation of the portion of Ttereve Drive lying west of Highland Drive and east of Olympic Drive and also a portion of Olympic Drive lying south of the north fork of Ttereve Drive and north of the south fork of Ttereve Drive. WHEREAS, the City Council of the City of Everett, did by Resolution No. 4898 duly adopt and fix the 24 day of May, 2000 at 8:30A.M., as the date of public hearing; and WHEREAS, said public hearing was continued until June 7, 2000; and WHEREAS, due and legal notice of the time and place of said hearing and determination of said Resolution has been given by the City Clerk in the manner prescribed by law; and WHEREAS, at the time and place fixed for hearing, the issues were publicly presented; and WHEREAS, the City Council finds it would not vacate said rights of way could it not retain easements for utilities in Olympic Drive and Ttereve Drive to be vacated; and WHEREAS, it now appears to the City Council of the City of Everett that the said rights of way resolved to be vacated should be vacated pursuant to the terms and conditions of this ordinance: NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: That the following described rights-of-way: All that portion of Ttereve Drive lying south of Block 2, north of Block 10, west of the westerly margin of Highland Drive and east of the easterly margin of Olympic Drive as shown on the Plat of Beverly Hills Division Number 1,recorded in Volume 10 of Plats at pages 76 and 77, records of Snohomish County. TOGETHER WITH: All that poriton of Olympic Drive lying easterly of Block 11, westerly of Block 10, as shown on the Plat of Beverly Hills Division Number 1, recorded in Volume 10 of Plats at pages 76 and 77, records of Snohomish County. Situate in the northeast quarter of Section 7,Township 29 North,Range 5 East, W.M., County of Snohomish, State of Washington. be and the same is hereby vacated pursuant to the conditions set forth in this ordinance.
