4 4. 4' <br /> r • <br /> • <br /> -43:14a ORDINANCE No. 2343 <br /> AN ORDINANCE regulating the sale and offering for sale of lubri- <br /> cating oil for the cylinders of internal combuddon engines , <br /> • and declaring an emergency. — <br /> The City of Everett does ordain : <br /> Section 1. CONTAINERS TO 3E LA3ELED. It shall be unlawful for any <br /> person, firm or corporation to sell , offer for sale or deliver, ot <br /> to cause r mit to be sold, offered for sale or delivered in the <br /> City of e any oil represented as lubricating oil for the <br /> cylinders of internal combustion engines unless there shall be firm- <br /> ly attached or painted, at or near the point of outlet from which <br /> said oil represented as lubricating oil for the cylinders of internal <br /> combustion engines is drawn or poured out for sale or delivery, a <br /> sign or label consisting of the word or words in letters not less <br /> than one (1) inch in height , comprising the brand or trade name of <br /> said lubricating oil; provided that when said sign or label is at- <br /> tached to the faucet or valve of a tank-wagon or tank-truck, the <br /> letters shall not be less than 3/4-inch in height and provided that <br /> if the above required sign or label is on a container having a capac- <br /> ity of fifteen (15) gallons or less, the letters shall be not less <br /> than *-inch in height, and provide4 that if any of said lubricating <br /> • oil shall have no brand or trade-name , the above required sign or <br /> label shall consist of the words, in letters not less than three <br /> (3) inches high,l with the exception above provided, "Lubricating <br /> oil , no brand". <br /> Section 2. FALSE LABELS It shall be unlawful for any person, firm <br /> or corporation to display any sign, label or other designating mark <br /> which describes any petroleum oil or petroleum product not actually <br /> sold or offered for sale or delivery at the location at which the <br /> sign or other designating mark is displayed or to display any label <br /> upon any container, which label names or describes a petroleum pro- <br /> duct not actually contained therein, but offered for sale or sold <br /> as such. <br /> Section 3. PENALTY Any person, firm or corporation violating any of <br /> the provisions of this ordinance shall, upon conviction thereof, be <br /> punished by a fine of not more than one hundred dollars ( 100.00) <br /> or by imprisonment in the city jail for a period of not more than <br /> :50 days , or by both such fine and imprisonment . <br /> Section 4. EACH DAY A SEPARATE OFFENSE. Each such person, firm or <br /> corporation-5771T—Fe deemed guilty of a separate offense for every <br /> day during any portion of which any violation of any provision of <br /> this ordinance is committed, continued or pelnitted by such person, <br /> firm or corporation, and shall be punishable therefor as provided <br /> by this ordinance . <br /> Section 5.
