ORDINANCE Page 1 of 19 <br /> <br /> <br /> <br />ORDINANCE NO. 4175-26 <br /> <br />An ORDINANCE Adopting Periodic Update to the City of Everett’s Critical Area Regulations, <br />AMENDING EMC Chapters 19.04 and 19.37. <br />WHEREAS, <br />A. The City of Everett is updating its critical area regulations under Chapter 36.70A of the Revised <br />Code of Washington and Chapter 365-190 of the Washington Administrative Code; and <br />B. The amendments contained in this resolution maintain consistency with the Growth Management <br />Act and are consistent with its planning goals; and <br />C. The amendments contained in this resolution are consistent with and supportive of goals, policies, <br />and implementation strategies in the Everett Comprehensive Plan, including: <br />1. Policy UF-41 Protect and connect the area’s network of habitat areas and wildlife <br />corridors, streams, parks, and tree canopy. <br />2. Policy UF-46 Designate, classify, and regulate protection of the following types of critical <br />areas, consistent with state law and state agency rules: fish and wildlife habitat <br />conservation areas, wetlands, frequently flooded areas, and geologically hazardous areas. <br />3. Policy UF-47 Incorporate Everett’s environmental assets as important resources and <br />components of the City’s infrastructure systems. Utilize the multiple benefits of the City’s <br />ecosystem services, including economic impacts, pollutant reduction potential, carbon <br />sequestration and the reduction of stormwater runoff. <br />4. Policy UF-48 Ensure that the city achieves no-net-loss of ecological functions over time <br />and strive for net ecological gain. <br />5. Policy UF-49 Preserve, enhance, and connect a network of habitat areas and corridors, <br />creeks, shorelines, parks, and tree canopies. Where possible, provide for public access in <br />critical areas and their buffers when these activities provide valuable educational or <br />recreational opportunity and can be designed in a manner that results in no net loss of <br />functions and values. <br />6. Policy UF-50 Use the best available science for managing critical areas and natural <br />resources and allow for updates to code as new information becomes available.
