w ; <br /> -7 .2 <br /> ORDINANCE NO. 2566-01 <br /> An Ordinance Amending Ordinance No. 1672-89, <br /> as amended, (Title 19 EMC), Amending the Text of the Zoning Code, <br /> for the B-2(B) (Office) Zone Providing for Freestanding Restaurants <br /> Occupying Up to 66% of the Total Floor Area of a Given Site <br /> WHEREAS, the City Council finds: <br /> 1) The City of Everett adopted a new Zoning Code in 1989, which established a B- <br /> 2(B) (Office) Zone to be used for office parks, restaurants in office buildings and other <br /> low impact uses; <br /> 2) The B-2(B) zone allows restaurants to take up to but no more than 25% of the <br /> floor area of a given building; and <br /> 3) The Planning Commission held a public workshop on September 25, 2001 and a <br /> public hearing on October 16, 2001, and recommended that the City Council approve <br /> revisions to the text on the MM zone; and <br /> 4) Planning Commission has recommended revision to the B-2(B) zone text as it <br /> relates to restaurant use in the zone; and <br /> 5) The amendments proposed to the Zoning Code are consistent with the applicable <br /> provisions of the Everett Comprehensive Plan; bear a substantial relation to public health, <br /> safety or welfare; and promote the best long term interests of the Everett community. <br /> WHEREAS, the City Council concludes: <br /> The proposed changes to the text of the B-2(B) zone as provided herein would benefit <br /> affected property owners as well as local business and the public in general, while not <br /> impacting residential property owners whose land abuts B-2(B) zoned areas. <br />
