w ; -7 .2 ORDINANCE NO. 2566-01 An Ordinance Amending Ordinance No. 1672-89, as amended, (Title 19 EMC), Amending the Text of the Zoning Code, for the B-2(B) (Office) Zone Providing for Freestanding Restaurants Occupying Up to 66% of the Total Floor Area of a Given Site WHEREAS, the City Council finds: 1) The City of Everett adopted a new Zoning Code in 1989, which established a B- 2(B) (Office) Zone to be used for office parks, restaurants in office buildings and other low impact uses; 2) The B-2(B) zone allows restaurants to take up to but no more than 25% of the floor area of a given building; and 3) The Planning Commission held a public workshop on September 25, 2001 and a public hearing on October 16, 2001, and recommended that the City Council approve revisions to the text on the MM zone; and 4) Planning Commission has recommended revision to the B-2(B) zone text as it relates to restaurant use in the zone; and 5) The amendments proposed to the Zoning Code are consistent with the applicable provisions of the Everett Comprehensive Plan; bear a substantial relation to public health, safety or welfare; and promote the best long term interests of the Everett community. WHEREAS, the City Council concludes: The proposed changes to the text of the B-2(B) zone as provided herein would benefit affected property owners as well as local business and the public in general, while not impacting residential property owners whose land abuts B-2(B) zoned areas.
